Description
In accordance with 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, and upon approval to use other than full and open competition, the Air Force (AF) plans to award a follow-on contract to sustain the Wave Relay Tactical Assault Kit (WaRTAK) system. This effort supports the Minuteman III Intercontinental Ballistic Missile (ICBM) Weapon System. WaRTAK was developed and fielded by the Air Force Research Lab (AFRL) on a Small Business Innovative Research (SBIR) contract to TSC Inc., subcontracted to Persistent Systems LLC (PS), that was awarded on 15 July 2011. On 28 September 2018, PS was awarded the current sole source Contractor Logistics Support (CLS) contract to sustain and maintain the WaRTAK system. This contract ended on 27 March 2024. This follow-on contract will be issued to PS, 601 West 26th Street, Suite 905, New York, NY 10016 (CAGE code 4YBU2), with an approximate award date of 16 September 2024. The Period of Performance (PoP) for this effort will be 16 September 2024 through 15 September 2029. �The Option to Extend Services clause, FAR 52.217-8, will be included in this effort. �If that clause is exercised the PoP could extend through 15 March 2030. A Sources Sought Synopsis was published on SAM.gov from 29 August 2022 (Reference Number: WaRTAK_Sources_Sought_2022) to 29 September 2022 to determine industry interest in competing for a WaRTAK sustainment contract. One large businesses and five small businesses responded. The Government contacted other similar businesses to make them aware of the Sources Sought on SAM.gov and provided them time to respond to the request. The results of this effort was that Persistent Systems was the only respondent contractor to meet the requirements. All of the other respondent contractors were unable to meet the requirements without subcontracting to Persistent Systems. The ICBM Systems Directorate believes that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. No other vendors possess the full combination of capabilities required to navigate the completion of the technical refresh upgrade without using PS as a subcontractor as PS owns the technological knowledge required to successfully field the WaRTAK system. PS is the original developer of Wave Relay technology and was contracted to integrate it into Android Tactical Assault Kit (ATAK) as an integral part of WaRTAK. As stated in the J&A for the current contract, PS asserted their proprietary rights to the Wave Relay technology as part of their subcontract in the WaRTAK AFRL SBIR contract. Under the WaRTAK AFRL SBIR contract, PS asserted the following Data Rights under DFARS 252.227-7017:� � - Provided with Limited Government Data Rights: Wave Relay� Technical Documentation, Technical drawings, Installation documentation, System-level schematics, and User manual� - Provided with Restricted Data Rights: Wave Relay� Software, Wave Relay� Code, Wave Relay� Firmware, Wave Relay� Android Applications, and Wave Relay� Algorithms� � The contract designates PS as the provider of all levels of support from Level-1 though Level-3. There is no other contractor or organic capability trained in WaRTAK systems maintenance. Additionally, the government does not have any baseline configuration documentation that could be released to any potential sustainment integrator because of its origin as an AFRL Rapid Innovation project and the on-going technical refresh of the current system. This follow-on sustainment contract to contract number FA820418C0003 will be for continuous maintenance and performance of a highly specialized service.�Because all Wave Relay technology and its integration into the WaRTAK system, now deployed, is proprietary to PS, PS is the only firm capable of providing the supplies described in Section III above without the U.S. Air Force experiencing substantial duplication of cost that could not be expected to be recovered through competition. This notice is not a request for competitive quotations. A solicitation will not be available for this requirement.� The intent of this notice is for informational purposes only. However, any information received from any organization, before 4:00 PM M.T., Saturday, August 31, 2024, that believes it can meet this requirement without subcontracting to Persistent Systems will be considered by the Government for a competitive procurement action. A determination by the Government not to compete this action based on this notice or any information provided is solely within the discretion of the Government.
