- The United States Department of Defense (DoD), Defense Counterintelligence and Security Agency (DCSA), Contracting and Procurement Office (CPO) intends to enter into a contract on a basis of other than full and open competition with Thomas Reuters Westlaw Publishing on behalf of the DCSA Office of General Counsel (OGC) and the Contracting and Procurement Office (CPO). The statutory permitting other than full and open competition is the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy the agency requirements. The DCSA Office of General Counsel (DCSA-OGC) has a requirement for readily available and reliable access to current, authoritative and accurate legal reference materials, including statutes, public laws, federal and state judicial and administrative case law, and legal treatises, with annotations and status notes for all of these materials both online and physical reference materials. Specifically, the reference materials must include access to the following: a. Physical access to current copies of the U.S. Code, Merit Systems Board Reporter, Corpus Juris Secondum, legal forms compendium, federal rules of civil and criminal procedure, federal acquisition regulation, as well as commentaries, annotations, and updates to these references; b. Extensive online access to legal databases including federal and state case law, statutes, regulations, administrative codes, legal encyclopedias, treaties, law reviews, and journals; c. Citation service, which allows users to check the validity of their research; d. Document analysis tools to help identify relevant legal authorities and insights. DCSA�s Contracting and Procurement Office (CPO) has a need for online access to the Nash and Cibinic Report (N&CR). The N&CR is a monthly, acquisition focused periodical that provides the personal insights from nationally recognized authorities in government contracting. N&CR is proprietary and only available from Westlaw. Only one online database and publishing company, Thomson Reuters, provides all of the federal legal reference materials and resources needed by DCSA-OGC and DCSA-CPO.� Westlaw Reference Materials and online access is only available through Thomson Reuters. The period of performance will contain a twelve (12)-month base period, plus four (4) 12-month option periods. The North American Industry Classification System (NAICS) code for this acquisition is 519290 Web Search Portals and All Other Information Sources and the size standard is 1,000 employees. This notice of intent is not a request for competitive quotes; however, all interested and responsible sources may indicate their interest and capability by responding to this notice. The Government will consider responses received by 2:30 p.m. EST on 16 August 2024. Inquiries will only be accepted via email to Ms. Tracey Fann at tracey.a.fann.civ@mail.mil and Mr. Jermaine Williams at jermaine.a.williams33.civ@mail.mil. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
