Description
EPA R6 Enforcement and Compliance Assurance Division Water Enforcement Branch to procure two (2) Teledyne FLIR E76 24� Cameras for water inspections and enforcement. NOTICE OF INTENT TO AWARD SOLE SOURCE The U.S. Environmental Protection Agency (EPA intends to negotiate on a sole source basis with Teledyne FLIR Commercial Systems, Inc., under the authority of FAR Part 13.106-1(b), for one (1) Firm Fixed Price (FFP) purchase order for two (2) Advanced Forward Looking Infrared Thermal Imaging Cameras. EPA policy, codified in the Clean Water Act (CWA), specifically the policy for water effluent discharges, explains the necessity for the use of the best available technology that is economically achievable and sets regulatory requirements based on the performance of that technology. As a result, equipment purchased by the EPA for use by its professionals (e.g., scientists, engineers, chemists, geologists, environmental protection specialists, etc.) must be capable of reliably collecting and analyzing data to ascertain the compliance of facilities� discharges with all EPA requirements outlined by EPA policy, notably the Monitoring, Assessment and Reporting Guidelines for water. The FLIR� E76 24� is singularly capable of collecting and analyzing all required data needed for determination of compliance with the regulatory standards identified in the Code of Federal Regulations, Title 40, Chapter I under Subchapters A, D, N, and O, and other EPA existing regulations. This requirement will utilize FAR Part 13. The North American Industry Classification System (NAICS) code is 334511 Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing (1,350 employees). Teledyne FLIR Commercial Systems, Inc., is the only possible contractor to provide the FLIR� E76 24� and only source reasonably available to meet the Government�s regulatory needs. We anticipate issuing a solicitation on or about June 6, 2024. THIS NOTICE IS NOT A REQUEST FOR PROPOSALS. Notwithstanding, any firm that believes it is capable of meeting the EPA�s requirement may submit a capability statement which must address the outlined requirements above. Such documentation must be submitted to the Contracting Specialist by 4:30 pm Central Daylight Time on June 5, 2024. A determination not to compete the proposed FFP purchase order based upon the responses received to this notice is solely within the discretion of the Government.
