Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C257-24-AP-1290 1. Contracting Activity: Department of Veterans Affairs, Regional Procurement Office West, Network Contracting Office 17 (NCO 17). 2. Nature and/or Description of the Action Being Processed: The proposed sole source action is for a firm-fixed price (FFP), contract with Dallas Independent School District (DISD) for offsite overflow parking and temporary material/equipment storage adjacent or within walking distance from the Dallas VA Medical Center. The period of performance shall be a base year plus four (4) 12-month option periods. 3. Description of Supplies/Services Required to Meet the Agency s Needs: The proposed action is to provide VA North Texas Health Care System, Dallas VA Medical Center, located at 4500 S. Lancaster Rd., Dallas, TX 75216 with offsite overflow parking and temporary material/equipment storage. A total of 550 dedicated overflow parking spaces are needed to offset current parking space shortages while construction of the new Long Term Spinal Cord Injury (LTSCI) Project is on-going. Parking and Temporary Material/Equipment storage areas must be adjacent to, or within walking distance from the Dallas VA Medical Center. The total estimated value of the proposed action is $1,116,667.20 (inclusive of options). In addition, FAR Clause 52.217-8 will be included in the contract which allows the government to extend services without negotiating short extensions. 4. Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3; ( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5; ( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6; ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7; 5. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): A survey of the area in close proximity (within walking distance) of the Dallas VA Medical Center identified three vacant lots that could be used to fulfill this requirement. The Dallas VA Medical Center s is surrounded by several local schools and the vacant lots are owned by the Dallas Independent School District. There were no other parking facilities/ vacant lots identified in close proximity to the facility. Accordingly, Dallas Independent School District is the only firm capable of providing the supplies and services described in Section III above without the Veteran s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted, details of which are in the market research section of this document. This effort did not yeld any additional sources that can meet the Government s requirement. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on SAM.GOV in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be determined fair and reasonable by comparison of proposed price with prices found reasonable on previous purchases and comparison with the Independent Government Estimate. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A sources sought notice was published on SAM.GOV on January 9, 2024. Responses were received from four (4) sources, however one (1) of these sources did not provide any documentation that demonstrated any capabilities to meet the Government requirements. The three (3) remaining sources include Life Safety Group, INQEM and Ecology Mir Group. Life Safety Group responded that they could provide 10 acres of space, they proposed 100 parking spaces per acre for a total of 6 acres for parking space plus extra space for the material/equipment staging area. However, the space proposed is 4.3 miles from the Dallas VA Medical Center, which does not meet the Government s requirement of being adjacent to or within walking distance from the Dallas VA Medical Center. Life Safety Group s solution would require a separate shuttle contract. INQEM stated that they could provide 611 parking spaces, however INQEM s proposed solution is neither within walking distance of the Dallas VA Medical Center, nor adjacent to the property. INQEM stated that it had two locations that were 1.5 and 1.7 miles away and proposed adding private shuttle services to offset the need to be within walking distance. Although the number of parking spaces available do meet the Government s requirement, the need for a shuttle service to transport Veterans and Employees to the and from the VA Medical Center does not meet the Government s requirement. Ecology Mir Group demonstrated limited experience providing parking space as a service, with the largest contract provided for 60 parking spaces in Austin, TX. Ecology Mir Group did not provide a location or the total number of parking spaces available, as such it was determined that they could not meet the Government s requirement. In addition to the sources sought notice, past procurement history was utilized to conduct market research. Past procurement history found that the Dallas Independent School District had previously provided a 350-space parking lot, and approximately 8.98 acres of unimproved land adjacent to the Dallas VA Medical Center for vehicular parking and staging of construction equipment and materials. This was previously provided in 2013 under VA257-13-L-0167 for a term of five (5) years. Based on this market research it has been determined that Dallas Independent School District is the only source that can meet the Government s requirements. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: All future requirements will be handled on a case-by-case basis to determine any future acquisition strategy.
