Description
DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C262-24-AP-3299 Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22, on behalf of the Greater Los Angeles VA Healthcare System, West Los Angeles VA Medical Center and Sepulveda VA Medical Center. 2237# 691-24-2-5042-0268 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Department of Veterans Affairs, Greater Los Angeles VA Healthcare System has a requirement for Integrity Tank Testing services in accordance with SB989, California State Water Resources Control Board delegated by the Environmental Protection Agency, and all other associate regulations for all underground storage tanks located within the Greater Los Angeles VA Healthcare System. This testing must be performed by a California certified UST testers with current licensing and credentials. California state certified UST technicians include designated operators, repair technicians, and testers have passed the California specific exams administered by the International Code Council (ICC). The Government intends to award a sole source award to IO Environmental Infrastructure Incorporated (SAM UEI: KR51LA1KAMP7) to perform the Integrity Tank Services as described above. The contract value is $54,905.00. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: Pursuant to 38 U.S.C 8127(b) and in accordance with Veterans Affairs Acquistion Regulation (VAAR) 819.7008, a Contracting Officer may utilize other than full and open competition procedures to award a contract to a certified service-disabled veteran-owned small business (SDVOSB) listed within the SBA certification database. IO Environmental Infrastructure Incorporated (SAM UEI: KR51LA1KAMP7) has a proven track record of delivering satisfactory servicesto various government agencies, including the Department of Veterans Affairs, thereby attesting totheir capability in successfully executing tasks. Their satisfactory past performance serves as a reliable indicator of their ability to maintain the highest standards of service delivery, compliance, and accuracy. IO Environmental Infrastructure Incorporated currently has an active status as a certified Service Disabled Veteran Owned Small Business within the Small Business Asssociation Veteran Small Business Certification (VetCert) program, further bolsters their suitability for this endeavor. Aligning with the Department of Veterans Affairs' commitment to supporting veteran-owned businesses and fulfilling socio-economic objectives while providing satisfactory services. Description of market research conducted and results or statement why it was not conducted: Market research was conducted utilizing multiple methods to include, reviewing the VetCert database, queries of other Government-wide databases, and the issuance of a source sought to the Government-wide Point of Entry www.sam.gov. The Veteran Small Business Certification (VetCert) database to identify verified capable SDVOSBs and VOSBs. Five hundred thirty eight (538) capable SDVOSB s and VOSB s were identified as able to perform services in accordance with NAICS 541380 Testing Laboratories and Services. IO Environmental and Infrastructure Incorporated (SAM UEI: KR51LA1KAMP7) was identified within VetCert as an Service Disabled Veteran Owned Small Business. System for Award Management (SAM) at www.sam.gov was queried for the verification of current SAM registration for IO Environmental Infrastructure Incorporated (SAM UEI: KR51LA1KAMP7). IO Environmental Infrastructure Incorporated has an active registration for all awards and expires 03/04/2025. Federal Procurement Data System (FPDS) at www.fpds.gov was queried for the identification of past procurements of Integrity Tank Testing by the Department of Veterans Affairs. Three (3) procurements were identified as follows: VA24612P0699 VA24616P3449 VA24117P0509 AbilityOne was queried at www.abilityone.gov to identify if the services required were listed on the AbilityOne procurement list for services. The queries of UST Testing and Integrity Tank Testing was not listed as available from AbilityOne. A sources sought (36C26224Q0805) was posted to SAM.gov on 03/13/2024 as a Veteran-Owned Small Business Set-Aside requesting capable vendors associated with NAICS code 541380 Testing Laboratories and Services to provide a capability statement in accordance with the Performance Work Statement. The sources sought closed on 03/20/2024 at 1PM. Only one response was received by IO Environmental Infrastructure Incorporated, a VetCert registered Service-Disabled Veteran Small Business. A search was conducted on FPDS.gov utilizing Integrity Tank Testing procured by the Department of Veterans Affairs to determine fair market price utilizing an informal price evaluation. The compilation of data revealed the following of integrity tank testing for one (1) storage tank: 3 Company Name Contract Number Total Contract Value Superior Testing Services VA24612P0699 $7,195.00 Superior Testing Services VA24616P3449 $3,600.00 Interspec, LLC VA24117P0509 $6,292.00 The market price established from the data above reflects a range of $3,600 to $7,195.00 for similar or identical services. The total average price is $5,695.66 per inspection of an individual tank. This acquisition requires the inspection of thirteen (13) tanks. An informal estimate utilizing the pricing history above suggests the total value of procurement should be $74,043.58. The estimated contract value of $54,905.00. would be considered fair and reasonable according to past procurement pricing. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
