- The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA) Acquisition and Grants Office (AGO), Western Acquisition Division (WAD) intends to issue a modification on a basis of other than full and open competition in support of the National Marine Fisheries Service (NMFS), Office of Law Enforcement (OLE). SCOPE: The Vessel Monitoring System (VMS) is a satellite and cellular surveillance system which is primarily used to monitor the location and activities of commercial fishing vessels in the U.S. Exclusive Economic Zone (EEZ) and international regional fisheries management organization (RFMO) areas. VMS supports law enforcement initiatives, for regulatory and statutory violation prevention, and for other fishery data-collection purposes. Data from VMS is used as evidence in the prosecution of many environmental laws and regulations including regional fishing quotas, the Magnuson-Stevens Fishery Conservation and Management Act (MSFCMA), the Endangered Species Act (ESA), and the Marine Mammal Protection Act (MMPA), to name a few. The system employs satellite and cellular-based communications from Enhanced Mobile Transceiver Units (EMTU), which are onboard transceiver devices that certain vessels must carry. The VMS program monitors over 4,000 vessels 24 hours a day, 365 days a year. This number of vessels will increase during the contract period; potentially up to 7,000 vessels. The NMFS OLE employs software to receive, store, and provide to users (via embedded graphical map display, graphical text display, or via export to common external data and (Geographic Information Systems software formats) the location and electronic reports of those commercial fishing vessels that are required by laws and/or regulations to install and operate an EMTU on board their vessel. The software is used by OLE staff, the United States Coast Guard, State enforcement agencies, and other fisheries-related personnel, totaling over 2,000 users. PERIOD OF PERFORMANCE: The period of performance for Option Period 2 is revised from September 22, 2023 through March 21, 2024 to September 22, 2023 through July 31, 2024. TECHNICAL REQUIREMENTS: OLE Standards: Data from VMS is used as evidence in the prosecution of many environmental laws and regulations including regional fishing quotas, the Magnuson-Stevens Fishery Conservation and Management Act (MSFCMA), the Endangered Species Act (ESA), and the Marine Mammal Protection Act (MMPA), to name a few. The NMFS OLE employs software to receive, store, and provide to users (via embedded graphical map display, graphical text display, or via export to common external data and GIS software formats) the location and electronic reports of those commercial fishing vessels that are required by laws and/or regulations to install and operate an EMTU on board their vessel. The software is used by OLE staff, the United States Coast Guard, State enforcement agencies, and other fisheries-related personnel, totaling over 2,000 users. Regulations governing VMS will be added, amended and modified, and/or augmented by Congress on a periodic basis. The VMS Program must comply with all regulations, which may necessitate various forms of modifications and upgrades to EMTUs� hardware, firmware and/or software; each of which may impact regulated communication, reporting, polling services, and procedures. NOAA requires by this PWS; support in the coordination, facilitation and logistical implementation and compliance of EMTUs within the VMS Program at all times. DELIVERABLES: -Security -Administration -Receive Messages -Reports and Data Queries -Alerts -Application Hosting SOLE SOURCE JUSTIFICATION: The contracting officer has determined the following circumstance justify the continued use of a sole source vendor as supported below: Competing for this transition period between the current contract and the re-compete would be inefficient and impact schedule as it could take up to 120 days from solicitation, contract award, and period of performance start date in order to hire contractor personnel. Competing this portion would also be duplicative of costs for both WAD and OLE. Re-competing this requirement would establish new discounted labor rates and these rates could potentially be higher than at time of the current contract award. Due to the re-compete currently taking place, OLE would be required to complete a new requirement package and WAD would be required to re-solicit this requirement, which would increase cost and hours spent on re-competing this transition period. Additionally, OPR would experience delays in performance as this work would not be able to be performed until a new contract is in place. OLE would not be able to clearly delineate the work done by Twoday and the other contractor because the tasks are integrally related. It may not be possible to for two (2) contractors to perform the work concurrently and would be difficult to administer, contributing to the inefficiency. The impact to the Government by recompeting this action could potentially create a Stop-Work situation, the lapse in service would cause a delay in service. This statement of work encompasses the following scope: 1. VMS Communication Services 2. VMS-related materials and services 3. Satellite surveillance software and systems integration; and 4. Application Hosting 5. Satellite surveillance software support and maintenance The Government purchased an entire suite of a company's products and services. Testing, software development, programming, and interfacing their product with communication providers are essential functions that are developed and managed by the company internally, as it all involves the companies' proprietary technology. It has been determined that it is not possible to contract with another company for these tasks because of statutory requirements and the proprietary nature of VMS systems.
