Description

The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research�s (CCR), Laboratory of Pathology (LP), Urologic Oncology Branch (UOB), and Pediatric Oncology Branch (POB) plans to procure, on a sole source basis annual maintenance services for six (6) Government owned Sartorius Incucyte Instruments from: Sartorius Corporation 565 Johnson Avenue Bohemia, New York, 11716� The response close date of the notice for this requirement is in accordance with FAR 5.203(b). This acquisition will be processed under FAR Part 12 � Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.106-1 (b)(1), and is exempt from the requirements of FAR Part 6. The North American Industry Classification System code is 811210 (Electronic and Precision Equipment Repair and Maintenance) which has a business size standard $34.0 Million. � To NCI�s knowledge Sartorius is the original manufacturer and only source able to provide maintenance for the IncuCyte instruments located at the CCR Laboratory of Pathology (LP), Urologic Oncology Branch (UOB), and Pediatric Oncology Branch (POB). Any material or service must be compatible in all aspects (form, fit, and function) with the existing systems currently installed, and able to connect or interface with other pre-existing systems. Only Sartorius, the original equipment manufacturer (OEM) of the IncuCyte S3 and Incucyte SX5, is capable of providing the support services because the equipment is proprietary to this company. As the only authorized service provider, Sartorius is the only source with direct access to OEM parts, propriety software, as well as factory trained technicians able to provide the services for the IncuCyte S3 and SX5. Sartorius does not offer any parts or services via third party vendors, and Sartorius does not authorize any other vendors to perform services for their equipment. Use of any other vendor would jeopardize system functionality by risking hardware and software standards, potentially compromising system integrity, functionality, and conflict with or void equipment warranties. Using any other source would significantly delay or endanger the scientific accuracy of ongoing research at CCR. Therefore, to the Government�s knowledge Sartorius is the only source that can meet the Government�s needs at this time. This notice is not a request for competitive quotations. However, if any interested party, especially a small business, believes it can meet the Government�s needs, it may submit a capability statement, proposal, or quote for the Government to consider. The response and any other information furnished must be in writing and must contain sufficient details to allow NCI to determine if the party can perform the requirement. Responses to this notice shall be submitted via email to Contracting Officer, John Russell, at John.Russell3@nih.gov no later than 10:00 A.M. EST on Wednesday, March 06, 2024 (03/06/24). A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. The Government reserves the right to use the information provided by respondents for any purpose deemed necessary and legally appropriate. Contractors must be registered and have valid certification through SAM.GOV.
