- NOTICE OF INTENT to Sole Source SOLICITATION NUMBER: �75N95024Q00040 TITLE: �On-Chip Service Plan CLASSIFICATION CODE: J066� Maintenance/Repair/Rebuild of Equipment � Instruments and Laboratory Equipment NAICS CODE: 811210 - Electronic and Precision Equipment Repair and Maintenance RESPONSE DATE: December 4, 2023 at 12:00 PM EST PRIMARY POINT OF CONTACT: Maggie Brant Maggie.brant@nih.gov Phone: 301.827.1771 DESCRIPTION: INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Center for Advancing Translational Sciences (NCATS) intends to negotiate on a sole source basis with PHC Corporation of North America an On-Chip Bio Full Coverage One Year Extended Warranty. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811210 - Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $34 million. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2024-01 dated November 14, 2023. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The Stem Cell Translation Laboratory (SCTL) within the National Center for Advancing Translational Sciences (NCATS) Division of Preclinical Innovation (DPI) requires the On-chip Sort microfluidic cell sorter and accessories in order to meet SCTL project milestones. The device leverages microfluidics to achieve low shear forces applied to cells unlike traditional cell sorters that put the sorted cells under a significant amount of stress from three major sources � high-pressure fluidics; application of a static charge to droplets encapsulating the cells; and the impact from a high travel speed from the nozzle to the target vessel into which the cells are being sorted. Damage-free sorting is a crucial step of the project since it enables obtaining single-cell suspension with the highest level of viability preservation. The sorter achieves this at a fraction of the time that is normally needed for repeated manual washes of the suspension which compromises viability, genomic integrity and introduces drastic changes to the expression profiles. Furthermore, the prolonged and laborious washing steps that were previously required would be prohibitive while processing the large number of samples in our experimental design. At the same time, 3 detection lasers allow for simultaneous sorting based on fluorescently labeled antibodies to obtain pure populations of interest. The resulting single-cell suspension will consequently have the highest possible quality and will enable accurate measurements reflecting the true biological mechanisms while leveraging the full potential of the existing single-cell analysis equipment at the SCTL.� NCATS requires an extended warranty for the On-chip On-chip Sort microfluidic cell sorter and accessories. SPECIFIC REQUIREMENTS: One (1x) PM per year Criteria for PM inspection: cleaning and lubrication of parts, visual inspection and adjustments, and replacements as needed. Replacement of parts due to deterioration or problem (determined by end user) Quantity: NA Period of Performance: One year- 12/27/23-12/26/24 CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, PHC Corporation of North America is the only vendor in the marketplace that can provide the service required by NCATS. However, interested parties may identify their interest to receive a Request for Quotation (RFQ) and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity Identifier (UEI), the Taxpayer Identification Number (TIN), and the certification of business size.
