- Requirement Description: The Government has determined that a Brand Name or Equal (BNOE) single award Requirements contract with Firm Fixed Price (FFP) orders is appropriate for this requirement IAW with FAR 16.503. The Requirements contract will consist of a base of 12-months with four 12-month option periods from the date of award. The Requirements contract for the identified NoninĀ® Pulse Oximeters noninvasively monitor Brand Name or Equal product line for all facilities will not only streamline the administrative process, but gain savings associated with leveraged quantity purchases as well. Historically, each individual medical facility and/or Veterans Affairs Integrated Service Network (VISN) procured these commodities independently using purchase orders or orders against the VHA Federal Supply Schedule. The use of BNOE purchase description is advantageous to the Government in this circumstance because the salient characteristics are firm requirements. In accordance with VA PPM 2016-05, VA considered all strategic sourcing vehicles, and these vehicles were examined however it has been determined to be in the Government s best interest to establish an Open Market Requirements Contract. A Requirements contract established IAW FAR 16.503(a) (1) and (2) allows greater flexibility and efficiency in the ordering of required equipment and allows the use of Ordering Officers to place orders directly against the resultant contract in that the line items will be pre-priced and negotiated. The use of a BPA (both open market and Federal Supply Schedule) was also considered; however, the vendor would not be contractually bound to perform throughout the entire period of performance and the risk of discontinued operations would negatively impact VA capabilities to provide the needed equipment in a timely manner. The total estimated quantities for this procurement are provided in the attached Product Description. The proposed acquisition is for a Requirements Contract with Firm-Fixed Price (FFP) orders IAW FAR 16.503, Requirements Contract. The type of Pulse Oximeters required for this program have been identified as most advantageous to the Government to be incorporated into a national Requirements Contract. The salient characteristics (SC) for these commercial items are identified in the NX EQ Pulse Oximeters Product Description. A single award Requirements contract will be awarded IAW FAR 52.211-6 Brand Name or Equal in accordance with all terms, conditions, provisions, specifications, and schedule of this solicitation herein. Quotes shall contain the terms for cost/price and technical capabilities of the brand name or equal equipment. The Government reserves the right to award without discussions. The associated North American Industrial Classification System (NAICS) code for this procurement is 339112 Surgical and Medical Instrument Manufacturing: 6515 Medical and Surgical Instruments, Equipment, and Supplies and the associated size standard is 1,000 employees. This procurement action is issued as full and open competition. SCHEDULE. All interested companies shall provide a quote for all Contract Line Item Numbers (CLINs) listed in ATTACHMENT A NX EQ Pulse Oximeters PRICE COST SCHEDULE. The ordering period is for one 12-month base year with four 12-month option years. Delivery is FOB destination. Firm-Fixed Price Orders will be placed against this contract in writing and will provide the delivery locations, delivery dates and exact quantities. The FAR provision at 52.212-1, Instructions to Offerors Commercial, applies to this acquisition including attached addenda to the provision. The FAR provision at 52.212-2, Evaluation -- Commercial Items, and the specific evaluation criteria as attached addenda also applies to this acquisition The Offeror is to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. Clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and a statement regarding any addenda to the clause. Addendum is attached. Clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition and a statement regarding which, if any, of the additional FAR clauses cited in the clause are applicable to the acquisition.
