- Description
- On October 20th 2023, the Naval Air Systems Command (NAVAIR) at Patuxent River, MD awarded a Cost Plus Fixed Fee (CPFF) contract modification to The Raytheon Company, Space and Airborne Systems (SAS), 2000 East El Segundo Blvd., El Segundo, California.� This award was on a sole source basis. The procurement provides the Low Rate Initial Production (LRIP) II contract with non-recurring engineering to support the update of the MB1/2 Array Control Interface (ACI) Assembly for producability and known obsolescence issues. The procurement includes the incorporation of blue wires, increase in Random-Access Memory (RAM) to at least 16GB with the Non Volatile Memory (NVM) selection and implementation capable of maximizing the full RAM capacity, and update of corresponding array firmware and software. The statutory authority permitting other than full and open competition is 10 U.S.C. � 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1: ""Only one responsible source and no other supplies or services will satisfy agency requirements,"" and more specifically 10 U.S.C. � 2304(d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii): ""Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered in competition; or (B) Unacceptable delays in fulfilling the agency's requirements."" This was not a commercial buy; therefore, the Government did not use the provisions of FAR Part 12 for this acquisition.� This synopsis is published for informational purposes only.
