Description
The Department of Veterans Affairs, Network Contracting Office 7, hereby provides notice of its intent to sole-source award to Sakura Finetek, Charlie Norwood VA Medical Center, 950,15th Street, Augusta, GA 30901, firm-fixed-price contract, for a base plus (4) four option years. The contract is expected to be awarded under FAR 13.106-1(b). A Justification and Approval for Other Than Full and Open Competition will be prepared. Determination of this sole source procurement is in accordance FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted because it is the Governments belief that there is only one responsible source, and no other supplies or services will satisfy agency requirements. The period of performance shall be: Option Year 1: 10/01/2023 through 09/30/2024 Option Year 2: 10/01/2024 through 09/30/2025 Option Year 3: 10/01/2025 through 09/30/2026 Option Year 4: 10/01/2026 through 09/30/2027 The contract will provide services and preventive maintenance for Tissue-Tek Instruments under a warranty/maintenance contract at the Charlie Norwood VA Medical Center, 950 15th Street, Augusta, GA 30901. NAICS: 811210 (SBA Size Standard 34 million). Sakura Finetek currently has a warranty/service contract for Tissue-Tek Instruments at Charlie Norwood VAMC. Any other vendor who tries to maintain or alters the existing systems would void the current warranty/maintenance contract. Also, only Sakura service parts and Sakura factory-trained technicians will be used to repair Sakura products. Voidability of said warranty cannot be permitted. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, interested parties may identify their interest and capability that provides clear and convincing evidence that the current warranty provided by Sakura Finetek for Tissue-Tek Instruments will not be voided by having a contractor other than Sakura Finetek conduct the above-referenced maintenance to respond to this requirement no later than September 22, 2023, at 9AM Eastern Time (ET). A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement. The Department of Veterans Affairs will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM) to be eligible for award. Interested parties are encouraged to furnish information by email only with RESPONSE TO INTENT TO SOLE SOURCE Sakura Finetek in the subject line no later than September 22, 2023, at 9AM Eastern Time (ET). All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements listed above to Contract Specialist Gail Bargaineer by email at gail.bargaineer2@va.gov. The capability documentation should include general information and technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements.
