- The Department of Veterans Affairs, Network Contracting Office 09, hereby provides notice of its intent to award a sole source, fixed-price basic purchase agreement (BPA) for Cellex sterile Photopheresis Procedural Kits and UVADEX Solution to Therakos, Inc., a Division of Mallinckrodt Pharmaceuticals. The contract is expected to be awarded in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically, FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303 2. A Justification under for Other Than Full and Open Competition has been prepared. The anticipated award date is December 31, 2022. The contractor will provide these products to the Tennessee Valley Healthcare System, Nashville VA Medical Center Campus, 1310 24th Avenue, Nashville, TN 37212. NAICS code: 339113 Surgical Appliance and Supplies Manufacturing (SBA Size Standard 750 Employees) PSC: 6515 Photopheresis is an FDA-approved apheresis procedure used to treat cutaneous T-cell lymphoma, graft-vs-host disease and transplant organ rejection. The Nashville Medical Center is the only medical center in the Veterans Affairs Healthcare System providing this procedure and has done so since 1988. THIS NOTICE OF INTENT IS NOT A SOLICITATION OR REQUEST FOR COMPETITIVE QUOTES. However, interested parties may identify their interest and capability to respond to this requirement within three calendar days after publication of this notice. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement. The Department of Veterans Affairs will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM) to be eligible for award. Interested parties are encouraged to furnish information by email only with RESPONSE TO INTENT TO SOLE SOURCE PHOTOPHERESIS KITS in the subject line. All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements listed above to Darrin Nicholson, Contracting Officer, by email at Cinnamon.Washington@va.gov NO LATER THAN 4:00 PM CDT, December 19, 2022 . The capability documentation should include general information and technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements.
