PRE-SOLICITATION NOTICE OF INTENT NON-COMPETITIVE NOTICE 75N95023Q00673 SUBJECT Premium Service and Maintenance Agreement for Zeiss LSM780 Two-Photon Confocal Imaging System (S/N 2504000389) NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811210 Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $34.0M.� REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, and the procedures prescribed in FAR Subpart 13.106-1(b)(1), Soliciting from a single source. The resultant contract will include all applicable provisions and clauses of the FAR in effect through the Federal Acquisition Circular (FAC) 2022-08, dated 10/28/2022. DESCRIPTION Pursuant to FAR Subpart 5.2�Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.� The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA), on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a purchase order for Premium Service and Maintenance Agreement for Zeiss LSM780 Two-Photon Confocal Imaging System (S/N 2504000389) used by its researchers and scientists in the Synaptic Function Section (SFS). The National Institutes of Health (NIH) is the nation�s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people�s health and save lives. The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), which mission it is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease for all people. The research program of the Synaptic Function Section of the DIR, NINDS focuses on focuses on mechanisms regulating axonal transport that is essential for the maintenance of synaptic function and axonal homeostasis. Specifically, interests cover a broad range of neuroscience research including molecular biophysics, synapses and circuits, neuronal development, integrative neuroscience, brain imaging, neurological disorders and stroke.� As such state-of-the-art imaging systems are used to accommodate this mission.� It is critical that these instruments, which are utilized by multiple laboratories and clinical programs across the NINDS, stay at peak performance. PLACE OF PERFORMANCE National Institutes of Health Bethesda, MD 20892 REASON FOR NON-COMPETITIVE ACTION The essential characteristics of the Premium Service and Maintenance Agreement for Zeiss LSM780 Two-Photon Confocal Imaging System (S/N 2504000389) that limit the availability to a sole source are that CARL ZEISS MICROSOPY, LLC is the is the only entity in the United States authorized by Carl Zeiss Microscopy GmbH (our German manufacturer) to provide comprehensive service and support for ZEISS LSM 7xx microscopes. Only Carl Zeiss Microscopy, LLC technical service representatives can engage directly with the engineers that designed Carl Zeiss instruments, to help resolve the most challenging technical support needs. CLOSING STATEMENT This synopsis is not a request for competitive proposals.� All responsible sources may submit a capability statement, however, which shall be considered by the agency. �Responses to this notice must include clear and convincing evidence of the offeror�s capability of fulfilling the requirement.� In addition, the Unique Entity Identifier (UEI), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. �All offerors must have an active registration in the System for Award Management (SAM). A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.� The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.�� All responses must be received by 3:00 P.M., Eastern Standard Time on September 14, 2023.
