Description
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with: MTS Systems Corp. 1400 Technology Drive� ��Eden Prairie, MN 55344, United States The sole source justification is based on the following: The National Institute of Standards and Technology, Applied Chemicals and Materials Division of the Measurement Laboratory Group (MML) performs testing for the hydrogen pipeline project within the fatigue and fracture group of the Materials Management Laboratory. The MML is seeking to purchase software to control two hydraulic load frames used for testing fatigue and fracture properties of steel. The two hydraulic load frames are utilized by the Hydrogen Pipeline project within the Fatigue and Fracture group of the Applied Chemicals and Materials Division of the Materials Measurement Laboratory. The two load frames use MTS 793 controllers. Updated software is needed to run the existing MTS 793 controllers with the two existing hydraulic load frames. The two hydraulic load frames currently run very outdated software, which risks both safety of the operator of the load frames as well as the integrity of data collected in the lab. To run these frames in a safe operating condition, updated software is required. Only MTS software can be used to ensure the controllers work appropriately and safely. Additionally, the load frames need to be calibrated regularly and using the original and most up-to-date software ensures that those calibrations can be performed. The alternative is to purchase new controllers and software for the load frame which is not cost effective and would require all the frames to be recalibrated. The only vendor that offers MTS software is the original equipment manufacturer, MTS. Given these facts, MTS Systems Corp. is the only source reasonably available to fulfill the requirement. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 513210- Software Publisher with a size standard of $47M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 1:00 pm August 25, 2023 will be considered by the Government. Responses must be submitted via email to the Government point of contacts listed below. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
