NOTICE OF THE INTENT TO SOLE SOURCE TO SpecOps Medical Supply, LLC, 3624 County Road 406, UNITED STATES. Response Due Date: August 04, 2023, by 10:00AM (EST) NOTICE OF THE INTENT TO SOLE SOURCE SYNOPSIS Network Contract Office 1, Procurement Office East on behalf of The Department of Veterans Affairs, Jamacia Plain VA Medical Center located at 150 S. Huntington Avenue, Jamaica Plain, MA 02130-4817 intends to award a firm-fixed contract with no options to SpecOps Medical Supply, LLC to provide delivery for the Bioventus L300 Go System. The proposed procurement is for products for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 41 U.S.C. 3304(a)(1). The North American Industry Classification System code (NAICS) for this requirement is 339113. All responsible sources that feel they should be considered qualified to provide the above-mentioned products may submit a response to this notice (by the response due date shown above) to Divianna.Mathurin@va.gov . The information provided shall include detailed (and relevant) documentation to allow the government to perform adequate market research and make a proper determination. A determination by the government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Statement of Work Boston s VA Healthcare System L300 GO SYSTEM INTRODUCTION: Jamacia Plain VA Medical Center is seeking to obtain equipment manufactured by OEM Bioventus. This is a brand name requirement. Huntington Avenue, Jamaica Plain, MA 02130-4817. Funding 523-23-3-7821-0192. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a new, brand name requirement. The Contracting Activity is seeking to obtain delivery for (1) L300 Go Foot Drop System. This equipment is being manufactured by OEM LB Bioventus, Inc., 4721 Emperor Boulevard, Suite 100, Durham, NC 27703 (UEI: UW53Z3LPK1M8) and solely distributed by SDVOSB SpecOps Medical Supply, LLC, 3624 County Road 406, McKinney, TX 75071 (UEI: FY9GN8SSGTU9). The L300 Go system is a functional electrical stimulation (FES) system that lifts your foot if you have drop foot. The L300 Go system uses functional electrical stimulation (FES) to help correct foot drop and thigh weakness in people coping with the effects of stroke, multiple sclerosis, and other medical conditions. Drop foot can occur as a result of diseases of the central nervous system such as multiple sclerosis and infantile cerebral palsy or after a stroke. The system sends a low-intensity electrical pulse down a nerve that runs from the knee to your ankle each time you begin trying to lift the foot to walk, forcing the foot to flex upward from the ankle, so toes don t drag. Estimated Amount ____________. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The L300 Go System is intended to provide ankle dorsiflexion in adult individuals with foot drop and/or to assist knee flexion or extension in adult individuals with muscle weakness related to upper motor neuron disease/injury (e.g., stroke, damage to pathways to the spinal cord). The L300 Go System electrically stimulates muscles in the affected leg to provide ankle dorsiflexion of the foot and/or knee flexion or extension; thus, it also may improve the individual s gait. The L300 Go System may also facilitate muscle re-education, prevent/retard disuse atrophy, maintain or increase joint range of motion, and increase local blood flow. The value in having a device at the Jamacia Plain campus will allow the clinicians at this site to trial the device with the veterans that are seen at this campus without requiring a separate referral or Physical Therapy evaluation at the West Roxbury campus where the only other device currently remains. Attempts have been made between the multiple clinicians at the West Roxbury site that use the device and Jamacia Plain campus to coordinate trials with only one device however this process is becoming challenging and is affecting the quality of patient care with staff having to travel from one location to another daily. Description of market research conducted and results or statement why it was not conducted: The Contracting Activity conducted its first search on VetCert using NAICS 339113 which borne rather broad results, 845 to be precise, none of which are authorized to provide this L300 Go System. SBA DSBS search using NAICS 339113 along with keyword Bioventus which generated 0 profiles matching those criteria, GSA search under manufacturer Bioventus borne 2 schedule contractors, however none of which are authorized by Bioventus to provide this particular L300 Go System. FPDS search using product name L300 Go System produced 11 contract actions, all of which were purchases of the same equipment to Boston s VA Healthcare System. Last search was on VetBiz using NAICS 339113 along with keyword Bioventus which returned 0 organizations. OEM LB Bioventus states this equipment is only available through their sole authorized distributor SDVOSB SpecOps. All market research leads to SDVOSB SpecOps being the only distributor for this L300 Go System. Since this requirement is above $25,000 an Intent to sole source notice was published IAW FAR 5.203 on 07/31/2023 with a closing date of 08/04/2023 with the intention of sole sourcing to sole authorized SDVOSB distributor SpecOps per VAAR 819.7008. The rule of two was not met.
