- Sources Sought Notice Sources Sought Notice Page 6 of 6 Sources Sought Notice *= Required Field Sources Sought Notice Page 1 of 6 This is a SOURCES SOUGHT ANNOUNCEMENT ONLY. It is neither a solicitation announcement nor a request for proposals or quotes and does not obligate the Government to award a contract. Requests for a solicitation will not receive a response. Responses to this Sources Sought must be in writing. The purpose of this sources sought announcement is for market research to make appropriate acquisition decisions and to gain knowledge of potential qualified vendors, to include Service-Disabled Veteran Owned Small Businesses and Veteran Owned Small Businesses, interested and capable of providing the services described below. Documentation of technical expertise must be presented in sufficient detail for the Government to determine that your company possesses the necessary functional area expertise and experience to compete for this acquisition. The North American Classification System (NAICS) code for this acquisition is NAICS: 562112 Hazardous Waste Collection ($41.5M) PSC: Q517 Medical - Pharmacology Responses to this notice shall include the following: (a) Company name (b) Address (c) Point of contact (d) Phone, fax, and email (e) SAM UEI number (f) Cage Code (g) Tax ID Number (h) Type of business (large or small) (i) If small business, type of small business, e.g. Services Disabled Veteran Owned Small Business, Veteran-owned small business, and (j) Must provide a capability statement that addresses the organization s qualifications and ability to perform as a contractor for the work described below. General: The Veterans Health Administration (VHA) has a requirement for removal of expired controlled substances (CS) and CS prescriptions set for destruction from VA facilities located in Arizona, California, and New Mexico, which are assigned to the Veterans Integrated Service Network (VISN) 22. These pharmaceuticals will be expired or in a condition that is not otherwise usable. Requirements: The contractor is required to be licensed with the Drug Enforcement Agency (DEA) as a reverse distributor to handle Schedule II V Controlled Substances. All necessary permits and licenses required by Federal, state, and local authorities shall be acquired and maintained by the Contractor for the life of the contract including required licenses, certifications, etc. for individual contractor staff. The Contractor shall have proper insurance coverage, including environmental remediation. A copy of such insurance coverage shall be provided to the Contracting Officer, upon request. To ensure the fulfillment of the contract within the allotted timeframe, the following services shall be provided per contract terms of the agreement: Labor: The contractor shall provide all labor associated with the removal of expired or controlled substances (CS) and CS prescriptions set for destruction. Response Times: The contractor shall be on site during the confirmed date and times for each site. The contractor shall always contact the pharmacy prior to arrival to confirm date and time of service at the site. Pick-ups will be performed at a monthly or quarterly date and time determined by the individual VA site, during regular business operating hours. Variance for federal holidays will be on days determined by the VA. Documentation: The contractor shall provide inventory reports which document each medication removed at each pharmacy site (in detail to be acceptable to the DEA). The following information must be provided in each service report: Date of service National Drug Code (NDC) or catalog number Facility DEA number Name of drug Strength Size Quantity Duties: The contractor shall be engaged, without interruption, full-time in the removal of expired or controlled substances (CS) and CS prescriptions set for destruction. Such removal duties will be performed in a continuous manner, until completion in order to maintain security and chain of custody. The contractor shall have access to pharmacy bins containing controlled substance medications. The contractor shall work on-site, in the pharmacy. The contractor shall, without exception, provide all computer equipment, software, boxes, shipping labels and anything else necessary to perform the work. The Contractor shall comply with any participating customers additional security requirements and procedures for access to facilities. All costs associated with gaining access to any customer facility shall be the responsibility of the Contractor. The contractor shall package the items for destruction on-site at the facility within a secure location in the Pharmacy. The contractor shall ensure the secure removal or pick up controlled substance returns from the facility by close of business the same day, or as soon as practicable, upon completion of the service and related boxing for shipment. The Contractor is responsible for the shipment and associated costs from the facility to the Contractor s registered destruction location. The Contractor shall list all controlled substances designated for disposal on a disposal manifest (chain of custody paperwork) and a DEA form 222 (when appropriate) will be generated and a copy left with The Chief of Pharmacy (or designated representative) and the narcotic vault with facility validation for accuracy prior to the removal of medications from the facility. Any discrepancies shall be resolved prior to removal of the pharmaceuticals from the facility by the Contractor. The manifest list will include at a minimum product name, National Drug Code (NDC) or catalog number, strength, dosage form, and quantity. The contractor s representative must sign the document listing the controlled substances transferred from VA to the destruction company and the appropriate DEA Forms (DEA form 222, 41 etc.). A Certificate of Destruction for controlled substances including the disposal date, destruction method, destruction location, weight, disposal company name and proof of destruction affidavit shall be provided to the returning facility and maintained on the reporting website upon completion of destruction. All Manifests shall be provided to the returning facility within 30 calendar days of Contractor's item receipt, except for the Certificate of Destruction/Affidavit which shall be provided within 30 days of the completion of destruction. The Government is not obligated to, nor will it pay for or reimburse any costs associated with responding to this Sources Sought synopsis request. This notice shall not be construed as a commitment by the Government to issue a solicitation or ultimately award a contract, nor does it restrict the Government to a particular acquisition approach. The Government will in no way be bound to this information if any solicitation is issued. The VA is mandated by Public Law 109-461 to consider a total set-aside for Service-Disabled Veteran Owned Small Business set aside. However, if response by Service-Disabled Veteran Owned Small Business firms proves inadequate, an alternate set-aside or full and open competition may be determined. No sub-contracting opportunity is anticipated. Notice to potential offerors. All offerors who provide goods or services to the United States Federal Government must be registered in the System for Award Management (SAM) at www.sam.gov and complete Online Representations and Certifications Application (ORCA). Additionally, all Service- Disabled Veteran Owned Businesses or Veteran Owned Businesses who respond to a solicitation on this project must be registered with the Department of Veterans Affairs Center for Veterans Enterprise VetBiz Registry located at http://vip.vetbiz.gov. All interested Offerors should submit information by e-mail to william.cook2@va.gov. All information submissions shall be received no later than 12:00 PM Mountain Standard Time on Monday, November 28, 2022. After review of the responses to this announcement, the Government intends to proceed with the acquisition and a subsequent solicitation may be published.
