- DEPARTMENT OF VETERANS AFFAIRS VETERANS HEALTH ADMINISTRATION June 13, 2023 SPECIAL NOTICE NOTICE OF INTENT TO SOLE-SOURCE TCGRX Equipment Maintenance & Repairs 36C25023Q0817 The Detroit VA Medical Center (VAMC) requires maintenance and repairs for The Chudy Group, LLC d/b/a TCGRX equipment. Network Contracting Office (NCO) 10 intends to issue a sole-source solicitation to TCGRX, N1671 Powers Lake Road, Genoa City, WI, 53128, requesting maintenance and repair services for the TCGRX ATP, LPU and InspectRx equipment. Per TCGRX s proprietary letter, TCGRX is the sole provider and only authorized distributor of the ATP pouch packaging systems within North America . [and] is the only company able to both cover under warranty and service the ATP pouch packaging [system]. TCGRx is the sole provider of the current software operating the ATP2 and InspectRx systems. Therefore, any software updates and upgrades can only be administered by TCGRx. The ability to configure the current hardware and add new hardware to the ATP2 and InspectRx is held only by TCGRx. The interface is solely maintained by TCGRx, and the information transferred between the pharmacy information system to an ATP2 and InspectRx device is modified as needed by TCGRx. TCGRx is the only authorized distributor in North America for the packaging film and ink ribbon utilized in the ATP2 and InspectRx. Only paper and ribbon purchased through TCGRx are to be used in the ATP2 and InspectRx to guarantee proper functionality and to validate service and software licensing agreements. In addition, any unauthorized supplies used on any ATP2 or InspectRx machine will void the warranty, extended warranty, and service maintenance agreement. As such, this procurement is being conducted in accordance with FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements. The NAICS code for this procurement is 811210, and the Small Business Administration Size Standard is $34.0 million. This notice of intent is not a request for competitive quotes. No solicitation document is available and telephone requests will not be accepted. However, any responsible source who believes it is capable of meeting the requirements may submit a quote, which may be considered by the agency, only if received by the closing date and time of this notice. Any response to this notice must show clear and convincing evidence that the responding company can meet the requirements of the Government. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government. Responses to this notice are due on or before Tuesday, June 20, 2023, at 10:00 a.m., Eastern Time, to Jeanne Ortiz, Contract Specialist, via email at jeanne.ortiz@va.gov.
