- Description
- The Social Security Administration (SSA) intends to negotiate with Microsoft Corporation (MC), located at 1 Microsoft Way, Redmond, WA 98052, on a sole source basis under the authority of 41 U.S.C. 253(c) and Federal Acquisition Regulation (FAR) 6.302-1. These authorities provide an exception to the Competition in Contracting Act (CICA) when there is only one responsible source and no other supplies or services will satisfy the agency's requirements. SSA intends to negotiate on a sole source basis with MC to acquire Microsoft Consulting Services (MCS) and Unified Support Services for SSA's mission-oriented information technology (IT) business functions and initiatives. All Microsoft software required for the agency's systems architecture, such as Windows, Exchange, and SharePoint, is proprietary to MC. Accordingly, MC is the only vendor that can provide system engineers with the technical knowledge necessary to assist in the design, installation, and implementation of these software products into the agency's computer network. Matching technology with agency business functions requires that a contractor have access to Microsoft proprietary software codes, access to future software releases, and access to confidential Microsoft planning documents and business plans. MC is the only vendor with the required access to these products. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. This is not a request for quotation, and the Government does not intend to pay for information received. A determination by the Government not to compete the requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive procurement.
