- INTENT TO SOLE SOURCE Eastern Research Group (ERG), Inc. SS-MSC-23-065 Upon final approval the Bureau of the Fiscal Service, on behalf of the U.S. Federal Mine Safety & Health Review Commission (FMSHRC), intends to make an award on a sole source basis to Eastern Research Group, Inc 561 Virginia Rd. Bldg. 4 Suite 300, Concord, MA, 01742-2767for Supplies and Services to complete the Blue Book requirement. The Eastern Research Group (ERG) produces Blue Books for documenting all the court hearing decisions and orders by FMSHRC�s Administrative Law Judges throughout each fiscal year. ERG receives orders and decisions from FMSHRC for them to format and update all the decisions and orders to make sure they match FMSHRC�s style guide and have consistent pagination and signature lines. Also, the Blue Book is used as a reference guide for the attorneys and the Administrative Law Judges to help them with a current case that may be similar to an older case. The Blue Book that ERG produces for FMSHRC is custom to FMSHRC and is only for internal use. Therefore, you will never see the Blue Book that ERG produces for FMSHRC on-line for purchase because it is not for purchase where everyone can buy it. FMSHRC believes ERG is solely unique to provide the product/service of producing FMSHRC�s Blue Books. These products being provided are proprietary to Eastern Research Group (ERG) and thus are only available from ERG. Therefore, the Government in accordance with FAR 6.302-1(a)(2)(ii), supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in a Substantial duplication of cost to the Government that is not expected to be recovered through competition. NO SOLICITATION IS AVAILABLE.� A request for more information, or a copy of the solicitation, will not be considered an affirmative response to this Special Notice. Telephone responses or inquiries to this Special Notice will NOT be accepted. Fiscal Service will consider written responses received no later than 10:00 AM EST Tuesday 5/9/2023. Responses must be submitted electronically to purchasing@fiscal.treasury.gov Attn: RB/GJ REF SS-MSC-23-065. Vendor responses must include sufficient evidence that clearly shows the proposed services are capable of meeting all of the services listed above. If no written response is received that clearly demonstrates an ability to meet all services and is received by the deadline, Fiscal Service shall make award on a sole source basis to ERG. Qualified contractors must provide the following: 1. The name and location of your company, contact information, and identify your business size and socioeconomic category (Large Business, Small Business, Disadvantaged Business, 8(a), Service Disabled Veteran Owned Small Business, HubZone, etc.).� Please ensure contact information includes the name of the point of contact, email address, and telephone number should the Government have questions regarding individual responses. 2. Whether your product is available through a Government contract vehicle or Open Market. 3. A brief capabilities statement (not to exceed 5 pages) that includes a description of your company's standard line of business, as well as a list of customers your company currently provides these products/services for. 4. UEI Number. The following file extensions are not allowable and application materials/data submitted with these extensions cannot be considered: .bat, .cmd, .com, .exe, .pif, .rar, .scr, .vbs, .hta, .cpl, and .zip files. Microsoft Office compatible documents are acceptable. No other information regarding this Special Notice will be provided at this time. This notice does not restrict the Government to an ultimate acquisition approach.� All firms responding to this notice are advised that their response is not a request that will be considered for contract award.� All interested parties will be required to respond to any resultant solicitation separately from their response to this notice, should one be issued. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Please note that the General Services Administration provides the notification service as a convenience and does not guarantee that notifications will be received by all persons on the mailing list. Therefore, we recommend that you monitor the SAM.gov site for all information relevant to desired acquisitions.
