Description
NOTICE OF INTENT TO LEASE SPACE USING OTHER THAN FULL AND OPEN COMPETITION  Pflugerville, TX   The U.S. Department of Veterans Affairs intends to award a lease using other than full and open competition to an approved Academic Affiliate in accordance with 38 U.S.C. § 8103(h)(1) for approximately 59,993 American National Standards Institute/Building Owners and Managements Association (ANSI/BOMA) Square Feet (ABOA SF) yielding a not to exceed amount of 67,424 Rentable Square Feet (RSF) of Outpatient Clinic Space in the area of Pflugerville, TX.    Notice: This advertisement is a notice of intent to award . This advertisement is not a solicitation for offers, nor is it a request for proposals. The Government is under no responsibility to respond or answer any inquiries regarding this advertisement. Respondents are advised that the Government assumes no responsibility to award a lease based upon responses to this advertisement.      Contracting Office Address:    Terri Wyche United States Department of Veterans Affairs (VA)  Office of Construction & Facilities Management  Office of Real Property, (003C1E) Email: terri.wyche@va.gov Description: VA seeks to lease approximately 59,993 ABOA SF/not to exceed 67,424 RSF of space and 350 parking spaces for use by VA as an Outpatient Clinic Space in the delineated area explained below within Pflugerville, TX.  VA will consider current or potential affiliate-owned or controlled assets to meet VA-defined technical space requirements. These assets could be construction of a new facility, unit or other subdivision or an existing facility, unit or other subdivision of an existing building that may be renovated for VA s exclusive use.      Lease Term: Up to twenty (20) years firm term.    Delineated Area: To receive consideration, submitted properties must be located within the following area described below, which is bound by the following roads, or must front on any of the following boundary lines:    Northern Boundary: Intersection of Hwy 183 and Route 1431, East on Route 1431 Southern Boundary: West on Hwy 290 Eastern Boundary: South on Hwy 1660 and South on Hwy 973 Western Boundary: North on Hwy 183 The below map of the delineated area is provided for further clarification of the boundaries of the delineated area.   Additional Requirements:  Review the following requirements with the customer; must be approved in writing by the Medical Center. The following is a list of potential requirements.  Adjust or delete those that do not apply.  These requirements will need to be transferred, verbatim, to section 1,04 Unique requirements on the R-100. (upon completion, delete this text).      General:  Offered space must be located on no more than two (2) contiguous floors and all space on each floor must be contiguous. If space offered is on two floors, a minimum of two (2) passenger elevators and one (1 combination (passenger/freight) elevators must be provided. Bifurcated sites, inclusive of parking, are not permissible.  The following space configurations will not be considered: Space with atriums or other areas interrupting contiguous space, extremely long or narrow runs of space (more than twice as long/as wide), irregularly shaped space configurations or other unusual building features adversely affecting usage.  Offered space cannot be in the FEMA 100-year flood plain.  Evidence that the Property is zoned in compliance with local zoning laws, including evidence of variances, if any, approved by the proper local authority.  If the current zoning is not in compliance, the Offeror must submit a plan and time schedule outlining how they will obtain all necessary zoning approvals prior to construction and how long the necessary zoning approvals will take. Space will not be considered where apartment space or other living quarters are located within the same building.  Loading dock or loading area is required.  Freight elevator required if loading area is on a different level than the offered space.  Parking lot must be able to accommodate deliveries by trucks with trailers.  Structured parking under the space is not permissible.     Offered space must be compatible for VA s intended use.  Offered space will not be considered if located in close proximity to residential or industrial areas.  Offered space will not be considered if located in close proximity to property with incompatible uses, including but not limited to the following uses: retail establishments whose primary purpose of business is the sale of liquor, treatment centers, correctional facilities (jails or otherwise), establishments whose primary purpose of business is involves firearms beingsold/discharged, railroad tracks, or within flight paths if flight paths are a noise or vibration disturbance.  Offered space must be located in close proximity to amenities including but not limited to restaurants, pharmacies, and shopping.    To be considered for the Market Survey, all submissions must include the following information, if applicable, by the Due Date described below:    Property owner or owner representative contact information (name, phone, and email);  Evidence the owner representative has the authority to represent the property owner;   Building address or address/described location of the land;  Provide the location on a map, demonstrating the building or land lies within the delineated area;  Description of ingress/egress to the building or land from a public right-of-way;   Description of the uses of adjacent properties;   FEMA map providing evidence of floodplain status;  Evidence of seismic compliance or willingness to upgrade;   Evidence of ABAAS compliance or willingness to upgrade;  Evidence of fire and life safety compliance or willingness to upgrade;  Evidence of sustainability standards or willingness to upgrade;  A narrative and map describing proximity of the building or land to the nearest public transportation and major transportation routes;  A description of any planned land development or construction that will affect the site, including neighboring projects and road/utility line construction;  Site plan depicting the property boundaries, building, parking, and amenities;  Floor plan showing the floor(s) and ABOA SF of proposed space;  A description of any changes to the property necessary to be compatible with VA s intended use;   A statement indicating the current availability of utilities serving the proposed space or property; and  Provide a statement and supporting documentation if available showing any environmental and/or cultural/historic studies that have been done on the property (e.g., Phase I or II ESAs, NEPA environmental assessments, or archaeological surveys).  Academic Affiliate Information: Affiliates may participate with VA for Real Property Leases under Section 704 of the PACT Act (38 USC 8103(h)); The affiliate must be listed on Veterans Health Administration s (VHA) Office of Academic Affiliate s listing of approved academic affiliates at https://vaww.oaa.med.va.gov/DBReports/GME/GmeAffiliationList.aspx; Space must meet minimum lease technical requirements including all VA/GSA accessibility, seismic, fire protection/life safety, and physical security requirements, or cannot provide space at current market rates, the procurement strategy will be full and open competition; If affiliate space does not meet VA space or technical requirements, competition must be sought, including compliance with VA s Rule of Two.    Due Date: All interested parties must respond to this announcement and provide the submissions for consideration no later than May 15, 2023 at 4:00 PM EST.   Submission Format: All submissions shall be sent via email to the following contacts: DHC Real Estate Services Attn: James Cassidy Email: James@dhcres.com Attn: Jonathan Luttwak Email: Jon@dhcres.com With a copy to: Terri Wyche, VA Contracting Officer Eboni Thornhill, Senior Realty Specialist Office of Construction & Facilities Management Office of Real Property/Lease Execution (003C1E) Email: terri.wyche@va.gov Email: eboni.thornhill@va.gov   Market Survey: The estimated Market Survey is the week of May 22, 2023.
