Notice of Intent to Sole Source THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE SERVICE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE QUOTES. Reference# HT941023N0040.� The Defense Health Agency Contracting Activity (DHACA), Western Markets Contracting Division (WMCD), San Diego, intends to award a firm fixed price contract in accordance with Federal Acquisition Regulation (FAR) 13.501(a) Sole Source acquisitions and FAR 13.106-1(b)(1)(i), only one source being available to meet the Government�s needs, to: MILESTONE INC. 25 CONTROLS DRIVE SHELTON, CT 06484 The North American Industry Classification System (NAICS) code for this requirement is 811219 � Other Electronic and Precision Repair and Maintenance; the business size standard is $22 millions of dollars. �The Product Service Code (PSC) is J065 � maint/repair/rebuild of Equipment � Medical, Dental and Veterinary Equipment and Supplies. The objective of this sole source award is to procure a five (5) year contract for service maintenance for the Milestone Direct Mercury Analyzer-80 for US Navy Public Works Center San Diego.� The Government anticipates issuing Federal Acquisition Regulation (FAR) Clause 52.217-8, Option to Extend Services, and reserves the unilateral right to continue performance of any services within the limits and at the rates specified in the contract for total term not to exceed 6 months.� In the event that this option is exercised, the total performance of the contraction will be 5 years. The requirement is a contract for procurement of a base plus four (4) year contract for service and preventative maintenance of the Milestone Direct Mercury Analyzer (DMA).� The laboratory at the US Navy Public Works Center San Diego analyzes several samples annually for air and urine samples using the Milestone Direct Mercury Analyzer (DMA) for mercury (Hg) analysis in IH and urine samples. The laboratory only has one DMA-80 evo and the lack of a service contract will create costly preventive maintenance services or delay work production due to possible issues with instrumentation ultimately generating a backlog and increased tum-around-times for the customers.� The contractor is the Original Equipment Manufacturer (OEM) and therefore are the sole proprietors of the service maintenance required. Requirements: The requirements are to provide the services as specified below in a timely manner, as specified below: 1 .��� The following services shall be delivered: Preventive Maintenance at least every twelve (12) months. Service(s) as needed to maintain the instruments running at optimal conditions. Prompt customer support via email or phone call as needed or required. Instrument parts (not to include consumables) to maintain instruments running at optimal conditions. Routine or as needed service as stated above, shall be acknowledged, and scheduled within a forty-eight hour (48) hour period after notification. Notification to contractor will be performed via email for routine and emergency needs/requirements of service(s). Emergency or unexpected needs of services will be notified to contractor via email and response shall be within a twenty-four (24) hour period where accommodation shall be, when possible, achieved in a seventy-two (72) hour period. Inoperable, dirty, and inadequate parts provided by contractor will be rectified or replaced immediately within the same day or by the next business day before noon. All services or parts necessary for instrumentation optimal conditions shall be of high quality and meet above suitable performance requirements. The laboratory shall be notified of servicing schedules in a timely manner via email. All services shall be delivered during regular working hours of 0700 to 1600 for which time a laboratory personnel shall be available for all services. No services shall be done outside regular working hours and without the presence of laboratory personnel. The contractor shall make the necessary arrangements to enter the facility independently. �If the contractor is unable to enter the premises independently, the contractor shall notify laboratory personnel in advance via email in order to escort the contractor.to the laboratory. Contractor Responsibilities: The contractor shall be responsible for the scheduling of services to accommodate the needs of the laboratory and optimum conditions of all parts used to provide services. �The contractor shall be responsible to provide accessories that shall be required for the use of any service noted above. �The contractor shall not assume possession or control of any instrument, part or license owned by the laboratory and shall provide replacement in the event of loss and damage. Contractor shall provide maintenance and repair services for all items listed in the Schedule. Services shall include on-site corrective repairs during normal working hour coverage from (8:00 AM to 4:30 PM; Monday through Friday, excluding Federal holidays), 24-hour emergency service, installation of software or engineering updates (if required) Milestone preventive maintenance services as recommended by the OEM, Milestone test and maintain the equipment and/or system in accordance OEM operating standards as specified in the schedule. Maintenance and repair services shall include all systems, subsystem components, and assemblies, the contractor shall be responsible for total maintenance of the entire system. �All maintenance provisions, and/or services shall apply to hardware, firmware, and software, as appropriate, unless otherwise stated. All replacement and/or repair parts shall be OEM certified replacement parts. �Substituted replacement and repair parts ARE NOT acceptable. Based on market research, MILESTONE, INC. is the only source that can meet the Government�s minimum requirement to provide base plus four (4) year service contract to US Navy Public Works Center San Diego. This notice of intent is not a request for competitive proposals and no solicitation document exists for the requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to provide the required service for US Navy Public Works Center San Diego. Capability statements shall not exceed 3 (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order. Capability statements are due by 1:30 Pacific Time, 11 April 2023.
