Attachment 1: Template for Combined Synopsis-Solicitation for Commercial Products and Commercial Services Effective Date: 03/15/2023 Revision: 01 Description This is a combined synopsis/solicitation for commercial products and commercial services prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Products and Commercial Services, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued. This solicitation is issued as an RFQ. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-02. This solicitation is for Full and Open competition. The associated North American Industrial Classification System (NAICS) code for this procurement is 334510, with a small business size standard of 1250 employees. The FSC/PSC is 6525. The Department of Veterans Affairs, WNY Healthcare System, located at 3495 Bailey Avenue, Buffalo NY 14215 is seeking to purchase Philips Healthcare X8-2T Transducer. All interested companies shall provide quotations for the following: Supplies/Services Line Item Description Quantity Unit of Measure Unit Price Total Price 1 Philips X8-2t Transducer Part # 453561842272 1 EA Statement of Work: Philips Healthcare Part# X8-2T TRANSDUCER Background: The Philips X8-2T Transducer is a 3D capable probe used frequently within the Cardiac Catheterization and Echocardiography Laboratory for heart patients. The TTE (transesophageal echocardiogram) demand has increased as well as patient echocardiograms to visualize any cardiac dysfunction related to the covid-19 diagnosis. Requirements: 1.TRANSDUCER, X8-2T 2. All parts will be new, standard OEM non refurbished parts that comply with applicable performance and reliability specifications. 3. Parts shall be warranted to be free from defects in material and workmanship for a period of twelve (12) months from the date of installation. 4. Upon completion of the repair, the Contractor will provide an electronic copy of the field service report (FSP) to the COR. 5. All work shall be completed within the following time frame: Monday-Friday, 8am 5pm, excluding holidays. 6. The Contractor warrants that all repair services will be performed according to current manufacturer s specifications for such equipment. 7. The Contractor warrants that the labor and services will be performed in a good and workmanlike manner and shall comply with all applicable laws and regulations. 8. The Contractor shall abide by the rules and regulations that relate to the privacy, security and confidentiality of patient information and patient-identifiable information. 9. The Contractor shall maintain at its sole cost and expenses, commercial general liability insurance for bodily injury and property damage liability. Delivery shall be FOB destination and provided no later than 30 days after the receipt of order (ARO.) The following solicitation provisions apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Products and Commercial Services FAR 52.212-3, Offerors Representations and Certifications Commercial Products and Commercial Services Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal in accordance with FAR 52.212-3, Offerors Representations and Certifications Commercial Products and Commercial Services. If paragraph (j) of the provision is applicable, a written submission is required. The following contract clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions Commercial Products and Commercial Services (Dec 2022) FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Products and Commercial Services (Mar 2023) The following subparagraphs of FAR 52.212-5 are applicable: As prescribed in 812.301(f), insert the following clause in solicitations and contracts for new medical and information technology equipment: GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023) (a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory. (b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics. (c) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. (End of clause) All quoters shall submit the following: quote via email with payment and delivery terms and letter of supply. All quotes shall be sent to Tracy Vega, tracy.vega@va.gov Award will be based upon a comparative evaluation of quotes in accordance with the Simplified Acquisition Procedures of FAR 13. Comparative evaluation is the side by side pairwise comparison of quotes based on factors resulting in a Contracting Officer decision for the quote most favorable to the Government. The following are the decision factors: The award will be made to the response most advantageous to the Government. Responses should contain your best terms, conditions. Letter of supply must be furnished by authorized distributor. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows: ""The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."" OR ""The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:"" Quoters shall list exception(s) and rationale for the exception(s), if any. Submission of your response shall be received not later than April 4, 2023, at 4pm EST. Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f).
