The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101.� Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, �Post-Award Ethical Responsibilities of Personal Services Contractors,� or otherwise objectively performing their contractual duties upon contract award.� HOW TO APPLY Offeror�s proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. The Department of State�s mission is to advance U.S. national security interests, fight terrorism, protect U.S. interests abroad, and implement foreign policy initiatives that build a freer, prosperous, and secure world. � Mission of the Bureau of International Narcotics and Law Enforcement Affairs (INL): INL is under the Under Secretary for Democracy and Human Rights (J) and works to keep Americans safe at home by countering international crime, illegal drugs, and instability abroad. INL helps countries deliver justice and fairness by strengthening their police, courts, and corrections systems. These efforts reduce the amount of crime and illegal drugs reaching U.S. shores. The principal, long-term goal of the INL program in Ukraine is to assist the host country in meeting European and international law enforcement and border security standards in preparation for eventual integration into the European Union (EU). This involves providing assistance to modernize and increase capacity of Ukrainian law enforcement and criminal justice institutions, fight corruption, combat organized transnational crime, and uphold the primacy of the rule of law.� Since Russia�s invasion in early 2022, INL has focused in the short term on supporting continuity of operations for Ukraine�s National Police and State Border Guard Service. INL is aggressively pursuing all options to provide life-saving equipment for the border guards and police. Successful delivery of this assistance to Ukraine requires coordination and collaboration with vendors and transportation companies, and among other donors and development partners in the law enforcement and criminal justice sectors.� INL takes a leadership role in ensuring effective coordination between the different stakeholders working in Ukraine. The purpose of this Personal Services Contract (PSC) is to provide subject matter expertise on INL Kyiv�s programs as assigned by Embassy Kyiv�s INL Director. The PSC will manage the day-to-day implementation, direction, execution, and oversight of a number of INL Kyiv�s programs in line with Embassy Kyiv�s Integrated Country Strategy. The PSC will also back-up other section personnel and assist with other Embassy needs as assigned by the INL Director, excluding managing U.S. direct hires. He/she will be expected to communicate to the U.S. Embassy�s Executive Office, the INL Bureau in Washington, other relevant Department of State bureaus, as well as other U.S. agencies and counterparts in U.S. Embassy Kyiv. The PSC will need to have a firm grasp of Department of State written reports and cables, abide by protocols for interacting and communicating with others in the mission and host government, and demonstrate strong management and interpersonal skills. DUTIES & RESPONSIBILITIES Under the direct supervision of the Kyiv-based INL Director or his/her designee, the Senior Border Security Advisor will perform the following duties: Review the host country�s border security needs; develop, manage, prioritize, and evaluate USG-sponsored border security assistance projects under the guidance and direction of the INL Director and INL/EA in Washington; while informing all stakeholders of the details of such implementation, including progress and problem areas. Lead strategic planning and development efforts in all phases of INL�s border security assistance. This includes project execution from the study and assessment period to development through acquisition and implementation; planning, scheduling, budgeting, monitoring, and coordinating among vendors, contractors, and Government of Ukraine (GOU) officials; and conflict resolution. Coordinate with GOU, civil society, and international donors to recommend border security reforms and to deconflict assistance.� Coordinate with INL Ukraine staff, INL/EA, and other U.S. Embassy sections (as needed and if appropriate), to assess, procure, donate, and deliver personal protective, operational, and other gear and equipment to the Ukrainian SBGS and other law enforcement agencies, as appropriate, and serve as a Contracting Officer�s Representative (COR) on relevant contracts. Coordinate with other agencies and stakeholders across the host country�s border security programs to ensure system-wide integration and functionality.�� Provide training to Ministry of Internal Affairs agencies on tactical and other subject matter as requested and appropriate.� Communicate and coordinate with other USG, international, and multinational donors to maximize effort and to avoid waste and duplication of effort.� Draft reports and assessments, provide input to strategy and other briefing papers, and provide oral and written briefs to the INL Director, the Embassy front office, INL/EA, INL Front Office and other Department offices and officials as needed.� Coordinate with other law enforcement agencies assigned to post, including but not limited to, all agencies that comprise the law enforcement working group (LEWG). Advise and assist in preparing documentation for procurement of systems and equipment, including drafting of electronic purchase requests (PRs), statements of work (SOWs), requests for source-origin waivers, sole-source justifications, and delivery and acceptance of systems, supplies and equipment procured.� Draft and provide advice and assistance in the preparation of required reports, including to INL, State Department principals, officials at other U.S. federal agencies, and Congressional offices. Attend and report on general border security meetings, national and international conferences and seminars, and meetings with Ukrainian government officials. Provide advice and assistance on end-use monitoring of U.S. government-donated equipment and commodities and provide input for end-use monitoring reports.� Provide advice and assistance in the formulation of the Mission Performance Plan and other strategy and planning exercises undertaken by Embassy Ukraine, and the INL and EUR Bureaus.� Participate in visits by senior officials and serve as an escort or control officer.� Arrange itineraries and logistical support for official visitors.� Brief DOS, Congressional, Embassy staff, and other visiting officials on the INL�s role and the status of U.S.-Ukraine border security projects and related initiatives.�� When required, perform the role of Duty Officer. Perform other duties as requested and assigned that are directly related to this Statement of Work. TRAININGS & DISTANCE LEARNING COURSES Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (CT650) prior to deployment to Post. Consultations with the INL Program Office may be required. PLACE OF PERFORMANCE & TRAVEL REQUIREMENTS The place of performance will be the U.S. Embassy Kyiv, Ukraine. Depending upon conditions in Ukraine, the place of performance may be located in Eastern Poland, Frankfurt, Washington, or other locales with frequent temporary duty trips into Ukraine. While the Department of State is committed to getting all staff posted to Kyiv and allowing dependent family members to accompany employees assigned to Kyiv, this position at present and for an indeterminant amount of time will be unaccompanied. RELATIONSHIPS The Advisor will report to the Kyiv INL Director or his/her designee. The Advisor will initiate law enforcement projects and execute approved programs under general supervision. The Kyiv INL Director will review the timeliness and effectiveness of the Advisor�s work. The Contract Administrator shall be the INL Contracting Officer in Washington.� In no instance shall the INL Director or any other individual be authorized to alter or modify the terms and conditions of the contract or waive the Government's requirements, price, delivery, or other terms and conditions. The Contracting Officer must authorize such changes in writing. The Kyiv INL Director will provide yearly performance reviews to the INL/EX/GAPP Contracting Officer in Washington, D.C. to contribute to the incumbent�s official yearly review. COMPLEXITY This position involves planning, organizing, and completing financial and organizational analysis of enormous complexity. Due to the high visibility and political sensitivity of the issues in which INL is involved, there can be extreme difficulty in planning, organizing, and evaluating the scope and depth of studies/audits to be undertaken to further the Department of State�s and INL�s strategic goals. The PSC is expected to address difficult and complex scenarios by separating the strategic goals of the programs into their component parts in order to clearly assess progress on each, and to ensure the intent of the relevant legislation and policies are being translated into program actions. SCOPE & EFFECTIVENESS The PSC performs broad and extensive assignments related to a complex administrative/financial program spanning the full range of citizen safety, law enforcement, rule of law, and counternarcotics programs in Ukraine, which is of significant interest to the U.S. public and to the U.S. Congress. PERIOD OF PERFORMANCE The period of performance for this contract is twelve (12) months from the date of award with four (4) optional one-year extensions. MINIMUM QUALIFICATIONS U.S. citizenship with the ability to obtain and maintain Department of State Secret level security clearance, medical clearance, and ethics clearance (if applicable). (Security clearance upgrade to Top Secret level may be required.) Bachelor�s degree from an accredited U.S. institution with a minimum of ten (10) years related experience in the fields of international development, law enforcement/border security, and/or public administration. OR; A high school degree with a minimum of fifteen (15) years of related experience in the field of international development, law enforcement, and/or public administration. A minimum of five (5) years demonstrated experience in program management, including budget preparation, the procurement of goods and services, and implementation and oversight of projects, preferably involving law enforcement/border security and training initiatives. Demonstrated ability to follow guidance and instructions on law enforcement/border security program implementation; analyze and determine true requirements; and propose feasible solutions for problems in program implementation. A minimum of two (2) years of demonstrated experience providing training and advice to, and/or managing assistance projects related to partner nation border security and/or law enforcement officials overseas. Demonstrated experience advising law enforcement/border security officials and managers on tactical and/or SWAT-type training techniques. Proficient in Microsoft Office Suite. Demonstrated ability to read and speak English at the professionally proficient level.� Demonstrated experience working overseas and maintaining positive working relationships in a cross-cultural setting, especially with foreign officials.� EVALUATION FACTORS (Used to determine the competitive ranking of qualified offerors in comparison to other offerors.) Factor 1��������� Program Management and Administration���������� (25 points) Demonstrated knowledge and experience in the application of sound management and program management practices, especially in international programs involving multiple agencies that include foreign government entities.� Experience in program management should include familiarity with procurement guidelines, budget development, and program planning, execution, and monitoring and evaluation.� Factor 2��������� Law Enforcement/Training Experience���� (25 points) Demonstrated experience and expertise in border security, rule of law, law enforcement, and/or related training programs.� Individual should demonstrate ability to understand and convey complex criminal justice sector and/or training issues.� These include, but are not limited to, border security/law enforcement operations, justice sector issues, financial crimes, drug demand reduction, procurement of commodities and equipment, training development and implementation, and logistics support.� Factor 3��������� Liaison and Communication����������� (10 points) Demonstrated experience building and maintaining relationships with host nation officials, U.S. government agencies, international organizations, and non-governmental organizations. Demonstrated ability to communicate complex issues in a timely and concise manner, both verbally and in writing. Factor 4�������� International Experience���������������������������������������� ����� (10 points) Demonstrated experience managing programs in foreign environments; to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. INL will not pay for any expenses associated with the interviews. In addition, applications (written materials and interviews) will be evaluated based on content as well as on the applicant's writing, presentation, and communication skills. In the event that an applicant has fully demonstrated his/her qualifications and there are no other competitive applicants, INL reserves the right to forego the interview process. COMPENSATION (BASE PAY) This position has been designated at the FS-02, GS-14 equivalent level ($95,225 - $139,841 per annum). Final compensation will be negotiated within the listed market value based upon qualifications, previous relevant experience and work history, salary and educational background. Salaries, including any recruitment supplemental pay that exceeds the listed pay range, will not be entertained or negotiated.
