Description
In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the Department of Energy (DOE), National Energy Technical Laboratory (NETL) intends to award a purchase order on a sole source basis to Rigaku Americas Corporation to purchase a replacement tube for our NETL-owned Rigaku wavelength dispersive x-ray fluorescence (WDXRF) spectrometer. The x-ray tube is no longer working, and it is not user serviceable. The original equipment manufacturer (OEM) replacement tube must be purchased, installed, and adjusted by a Rigaku technician per our service agreement with Rigaku. The purchase and installation of replacement parts must be through Rigaku in order to keep the existing service agreement valid. This is considered a sole source to Rigaku because, to the best of the NETL�s knowledge based on market research conducted, Rigaku is the only known source that can provide this exact OEM x-ray tube and installation by a Rigaku qualified technician. To assure continued reliable operation of this equipment, exact replacement parts must be obtained and utilized from the original equipment manufacturer (OEM), which is Rigaku Americas Corporation. Rigaku is the sole source provider of their replacement parts and the sole source installer of these parts. Rigaku does not have any authorized resellers or distributors. No known potential alternate sources exist which could satisfy NETL's requirement. This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 4:00 PM ET on March 10, 2023. Responses must be submitted in writing to the purchasing agent, Lora Stumpf, via email at stumpf@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
