- Description
- The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD) and the Office of Marine and Aviation Operation (OMAO), using the procedures set forth in Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items and FAR Part 13.5, Simplified Procedures for Certain Commercial Items intends to negotiate on a sole source basis with L3Harris Technologies, Inc. (L3Harris) located at 1500 New Horizons Blvd, Amityville, NY 11701 for a firm-fixed price contract for the evaluation and repair of one spare Front End Receiver (FER) for the lower fuselage Multi-Mode Radar (MMR) system used to fly missions into severe weather to obtain data for weather forecasts on the WP-3D Hurricane reconnaissance aircraft. L3Harris is the only source for any work on the Multi-Mode Radar System. These units are unique to the MMR and its software is unique to NOAA�s WP-3D hurricane research aircraft. L3Harris is the only company in the United States that holds all copyright, licenses, schematics, and software coding. The required services must be compatible in all aspects (form, fit, and function) with existing systems and equipment and the source is uniquely qualified to meet the requirement. Should another manufacture perform the troubleshooting, repairs, and software updates to the aircraft�s equipment, it would no longer be compatible with the existing systems and would not allow for the flight crew to maintain 360 degree situational awareness during collection of hurricane data. L3Harris is the Original Equipment Manufacturer (OEM) and sole firm that owns the proprietary rights to this equipment and therefore is the only business that can provide the repairs and provide the needed software update. The North American Industry Classification System Code (NAICS) is 334511, Search, Detection, Navigation, Guidance, Aeronautical, Nautical System and Instrument Manufacturing. This notice does not constitute a solicitation, Request for Proposal (RFP), Request for Quotation (RFQ), or an Invitation for Bid (IFB) and it does not restrict the Government in any way regarding its ultimate acquisition approach. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
