This contract shall be an Indefinite Delivery, Requirements contract with fixed unit prices (IAW FAR 16.503 Requirements Contracts) with Economic Price Adjustments (IAW FAR 16.203 Fixed Price Contracts with Economic Price Adjustment). The Contractor shall provide all supervision, plant, labor, equipment and materials necessary to perform all work in connection with construction of new and repair/replacement of existing asphalt pavement in accordance with the Statement of Work, Site Plans, and subject to the terms and conditions of the contract. The Contractor shall perform the work in strict accordance with the contract and all applicable federal, state and local laws, regulations, codes, directives, and Installation policies. The Contracting Officer has classified this requirement as Highway, Street and Bridge Construction, North American Industry Classification System (NAICS) code 237310. The small business size standard is $45 million. The magnitude of this requirement is estimated to be between $10,000,000 and $25,000,000 (five-year ordering period). In accordance with FAR Part 36.211 Distribution of Advance Notices and Solicitations, contractors are required to submit requests for equitable adjustment as a result of change orders to the issuing Contracting Officer. Contractors are required to acknowledge the change order within 30 days and are to submit their request for adjustment which includes all supporting documents as soon as possible, but not later than the required completion date of the contract. In the table below is the agency�s past performance, for the period of three fiscal years, regarding the time required to definitize equitable adjustments for change orders under construction contracts.
