- The Department of Veterans Affairs, Network Contracting Office 17, intends to award a Firm Fixed Price, Sole Source contract under the authority of FAR 6.302-1(a)(2)(ii) to Philips North America, LLC, 22100 Bothell Everett Hwy, Bothell, WA 98021 for the procurement of Philips Radiology and Imaging Equipment Service Maintenance currently in use at Audie L. Murphy Memorial Hospital, South Texas Veterans Health Care Systems. This order for the maintenance service for the Philips Radiology and Imaging Equipment, is to be performed for one (1) base year and (4) option years of contract award, will be placed on a sole source basis with Philips North America, LLC as the following circumstance in FAR 13.106-1(b) applies: only one source is capable to provide the services required at the level of quality required because the requirements are already purchased and have not exhausted their lifecycle, purchasing the service maintenance in support of the equipment after initial warranty expiration ensures the equipment is compliant with VHA technology standards and policies. The contractor s Radiology & Imaging Systems are proprietary; therefore, any follow-on maintenance is required to be performed directly by the original equipment manufacturer (OEM) and not outsourced to a third-party to maintain the integrity of the equipment and to avoid contractors not familiar with the products causing damage to the equipment. If damage is caused by a third parties in the course of repairs, then the Government will be held liable for additional costs associated with repairs performed by the OEM after damage has occurred. Delivery schedule will be discussed prior to issuing the contract award. The anticipated award date is December 31, 2022. This notice is not a request for competitive quotes; however, that all responsible sources and interested parties may identify their interest and capability to meet the requirements by submitting technical data for this requirement data within 15 calendar days of this notice posting (no later than December 19, 2022, by 08:00 AM CST, to Angela Kyte, via email at angela.kyte@va.gov which shall be considered by the agency.
