Description
1. The United States of America, acting through the Millennium Challenge Corporation (�MCC�) and the government of Benin (the �Government� or �GoB�) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Benin (the �Compact�) in the amount of approximately 391 000 000 USD (�MCC Funding�). The Government, acting through Millennium Challenge Account-Benin II (the �MCA Entity�), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Invitation for Bids (IFB) is issued. Any payments made by the MCA Entity under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use and distribution of MCC Funding. No party other than the Government and the MCA Entity shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. 2. MCC�s funding is appropriated by the U.S. Congress and obligated to the Compact up-front, with no incremental or partial funding. So, when a contract is signed with an MCA Entity, money is already available to the MCA Entity and, for most contracts, invoices are paid directly to Contractors/Bidders/Suppliers by the US Treasury. 3. The Benin Power Program consists of four (4) Projects: (i) Policy Reform and Institutional Strengthening Project; (ii) Electricity Generation Project; (iii) Electricity Distribution Project; and (iv) Off-grid Electricity Access Project. The objective of the program is to increase the productivity and production for businesses, generate more economic opportunities for households and improve the capacity to provide public and social services by improving the quantity and quality of power supply. The Compact will be executed for a period of five (5) years upon the Compact Entry into Force (EIF). The Power Compact of Benin entered into force on June 22, 2017. To meet the challenges of the Covid-19 pandemic, the Compact has been extended until June 22, 2023. This Notice is part of the �Electricity Distribution� Project of the Benin Compact. 4. This Invitation for Bids follows the Compact General Procurement Notice N�18 that appeared in dgMarket on October 13th, 2022, UNDB Online on October 14th, 2022, on the MCA Entity website www.mcabenin2.bj on October 18th, 2022, and published in the local newspaper �La Nation� on October 20th and 27th, 2022 and �Le Matinal� on October 20th and 24th, 2022. 5. MCA-Benin II, acting on behalf of the Government of Benin, invites qualified Bidders to provide their best Bid for the procurement related to the Acquisition of PowerFactory Software Server license with unlimited number of multiple access nodes for five (05) simultaneous computers and two (02) single-user licenses with support, maintenance, and warranty for two (02) years. More details on the Goods and Related Services are provided at Section V (�Supply Requirements (Specifications for Goods and Related Services)�) of the bidding document. 6. This Invitation for Bids is open to all eligible entities (�Bidders�) who wish to submit a Bid. 7. This procurement in reference consists of one unique lot with base and option package. 8. One bidder will be selected using the Competitive Bidding (CB) method as part of open bidding procedures, as described in the relevant sections of the Bidding Document. Bidders are informed that these procedures are governed by the MCC Program Procurement Guidelines (PPG), which can be found on the MCC website: www.mcc.gov. 9. The Bidding Document consists of: PART 1 � BIDDING AND SELECTION PROCEDURES: Section I � Instructions to Bidders (""ITB""); Section II � Bid Data Sheet (""BDS""); Section III - Qualification and Evaluation Criteria; Section IV - Bid Forms. PART 2 - SUPPLY REQUIREMENTS: Section V - Specification of Goods and Related Services. PART 3 � CONDITIONS OF CONTRACT AND CONTRACT FORMS: Section VI - Contract Notices and Agreement; Section VII � General Conditions of Contract (""GCC""); Section VIII - Special Conditions of Contract (""SCC"") and Contract Annexes. 10. Bidders interested in submitting a Bid must express their interest by sending an e-mail with their full contact details to the contact point below: Procurement Agent of MCA-Benin II, info-benin@charleskendall.com A copy in PDF of the IFB will be sent by e-mail with the File Request Link for Bid submission. 11. All Bids must be accompanied by a Bid Security in the form and amount specified in the Bid Data Sheet (BDS). 12. The closing date and time for receipt of Bids is December 23rd, 2022, at 10:00 a.m. (Cotonou time). Please note that only electronic Bids are accepted. Bidders are informed that the capability of their internet bandwidth will determine the speed in which their Bids are uploaded via the File Request Link. Bidders are therefore advised to commence the process of uploading their Bids via the File Request Link in good time before the bid submission deadline and submit their Bid by the established deadline.
