Description
LIMITED SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM GS-35F-470BA Task Order 15PADH22F00000016 Upon the basis of the following justification, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405- 6(c), I hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(C). 1) Identification of the agency and the contracting activity [FAR 8.405-6(c)(2)(i)]: U.S. Department of Justice (DOJ) Office of Justice Programs (OJP) Office of Administration (OA) � Human Resources Division (HRD) Contracting Activity: Office of Justice Programs Acquisition Management Division (AMD) 810 7th Street, NW Washington, DC 20531 2) Nature and/or description of the action being approved [FAR 8.405-6(c)(2)(ii)]: This action is to award a contract for software and service solutions for OJP�s mobile workforce to reserve and manage conference rooms and workstations within OJP�s building to AgilQuest Corporation via their Federal Supply Schedule. In the interest of economy and efficiency, this action is awarded as a logical follow-on to an original contract. The original contract was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The anticipated performance period of this contract will be for a 12-month base period and 2 12-month option periods. 3) A description of the supplies or services required to meet the agency�s needs (including the estimated value) [FAR 8.405-6(c)(2)(iii)]: The scope of this effort is for the contractor to provide a workplace management system for employees to make conference room and workstation reservations using software that has been previously customized for the current OJP building, and integrated with mobile app, conference room tablets, and other systems at the OJP. The estimated value of the contract is approximately $192,234.75 for three years. 4) The authority and supporting rational, and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. [FAR 8.405-6(c)(2)(iv)]: This action is issued in accordance with FAR 6.302-1. In the interest of economy and efficiency, this action is a logical follow-on to an original contract. There is only one responsible source for the BookIt software, and AgilQuest Corporation is the only reseller and servicer of the product. The original contract was placed in accordance with the applicable Federal Supply Schedule ordering procedures. 5) A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d). [FAR 8.405-6(c)(2)(v)]: The solicitation was originally issued to a single source, Commercial Marketing Associations, Inc. (CMA), who subcontracted to AgilQuest Corporation to provide the BookIt software. After the full period of performance, OJP issued another solicitation to AgilQuest to provide BookIt software as the prime vendor. In accordance with FAR 8.404(d), GSA has already determined the prices of supplies and fixed-price services to be fair and reasonable. As a result, OJP will confirm that any quoted rates under this contract are equal to, or less than, the vendor�s established GSA rates. 6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. [FAR 8.405-6(c)(2)(vi)]: In 2014, OJP released an RFP seeking the acquisition of a robust, user-friendly, self-service workplace scheduling system. Following the RFP process, in September 2014, OJP entered into an Order for Supplies and Services with CMA to implement the BookIt workplace scheduling software system via a subcontract with AgilQuest Corporation. At the time the RFP was released, AgilQuest Corporation was not on the GSA schedule; however, they were subsequently added to the schedule and are currently listed as a veteran-owned business. AgilQuest Corporation is the creator, official reseller, and servicer of the BookIt software system and has customized the BookIt software system specifically for OJP�s current building layout of eight floors, including 45+ conference rooms, and 180+ mobile workstations. In 2019, OJP contracted directly with AgilQuest Corporation to provide BookIt software and support services. 7) Any other facts supporting the justification [FAR 8.405-6(c)(2)(vii)]: OJP�s current building lease for 810 7th Street, NW, expires on October 31, 2024. OJP is currently working through our federal partners at GSA to construct OJP�s new building location in advance of the expiration of the current lease. OJP�s new building location will require a new workplace scheduling system optimized for that building and its resources. The current BookIt system used throughout the current OJP building and is highly customized to reflect our current physical space and is mapped to our 45+ conference rooms, 180+ mobile workstations, and 50+ digital room wizard scheduling tablets outside of each conference room. Moreover, our customer base of approximately 1,200 users is trained in the current version of the system. Given that the new OJP building will require a new system, it is in OJP�s best interest to continue utilizing the current version of BookIt in its current building. 8) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. [FAR 8.405-6(c)(2)(viii)]: In executing this action for a follow-on contract with AgilQuest Corporation, OJP intends to reasonably maintain the integrity of the original agreement that was competitively awarded. AgilQuest is the only provider of the BookIt software that is currently used and customized for OJP�s building. Therefore, a follow-on contract to get through the end of the current period of performance until a move to a new workspace justifies the cost and burden of a issuing a new competitive procurement. As such, the estimated value of the follow-on contract will be equal to or less than the original contract. That is, the ceiling amount will be approximately $192,234.75. OJP will not extend the duration of the followon contract for a new five year ordering period. Rather, OJP will generally align the ordering period with the remaining duration of the lease at OJP�s offices located at 810 7th Street NW in Washington DC. Once the ordering period for this contract expires, OJP intends to evaluate its requirements at that time, and will plan to issue a competitive action, influenced by the market research conducted at that time.
