- (i)� �This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii)� �The solicitation number is 75N95023Q00021 and the solicitation is issued as a request for quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures; �and FAR Part 12�Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME).� The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA), on behalf of the The National Institute on Aging (NIA), intends to negotiate and award a Firm Fixed Priced contract without providing for full and open competition (including brand-name) to Thermo Electron North America LLC,1400 Northpoint Pkwy Ste 50, West Palm Beac, FL 33407-1976 for a maintenance and repair service for ThermoFisher Mass Spectrophotometer equipment. This acquisition is conducted as non-competitive for a commercial item or service and is conducted pursuant to FAR 13.106-1(b)(1). The rationale for the sole source justification is that Thermo Electron North America LLC is the manufacturer of the instruments, and as such they will not outsource the maintenance and repairs of said instruments to another company. Thus, Thermo Electron is the only vendor available to use for a service agreement for ThermoFisher Mass Spectrophotometer equipment. The vendor does not offer any parts or service to third party distributors. No other vendor has access or knowledge of this system or software. (iii)� The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) Number 2022-06 dated May 26, 2022. (iv)� The associated NAICS code 811219 � Other Electronic and Precision Equipment Repair and Maintenance and the size standard in millions of dollars is $20.5. This requirement is a small business set-aside. (v)� �This requirement is for a maintenance service contract for ThermoFisher Mass Spectrophotometer equipment. (vi)� The agreement will include depot hardware and software maintenance/support. Background: The National Institute on Aging owns an Orbitrap Eclipse manufactured by Thermo Electron. This equipment is used by the Center of Alzheimer�s Disease and Related Dementias and requires maintenance to ensure continued full function and continuity of NIA research data. Purpose: The purpose of this requirement is to procure maintenance support services for ThermoFisher-manufactured laboratory equipment owned and operated by the National Institute on Aging. The contractor shall provide all resources necessary to accomplish the tasks and deliverables described in the Statement of Work (SOW). Project Requirements: The Contractor shall provide the Government with maintenance and repair support for the following Thermo Electron instruments: Orbitrap Eclipse- S/N: FSN40137 Maintenance and repair support shall include all labor, travel, and replacement parts necessary to provide preventative maintenance support, install new instrument software upgrades and train staff in use of the new software, and troubleshoot problems. Replacement parts and software upgrades provided must be Original Equipment Manufacturer (OEM) certified. Original manufacturer certified trained technicians from Thermo Electron required to troubleshoot problems, install new software upgrades, train staff, and perform preventative maintenance tasks. Service technicians shall acknowledge repair requests within 24 business hours, and an onsite visit from a technician shall occur within 72 business hours. No travel reimbursement is authorized for this requirement. Additional Requirements: Vendor staff will provide reporting transfer thru email . The contractor shall comply with Section 508 of the Rehabilitation Act (29 U.S.C. � 794d), as amended by the Workforce Investment Act of 1998 (P.L. 105-220), August 7, 1998. The vendor is to provide reports which detail all maintenance and repair work performed for each instrument during the reporting period. Key Personnel: �Vendor will provide a dedicated project manager to the government as a contact point for the services. Deliverable: The Contractor shall provide one report to the Government via email on a quarterly basis which details all maintenance and repair work performed for each instrument during the reporting period. The report shall be due on the last business day of each quarter Government Responsibilities: When the Contractor is on-site for maintenance and repair support provision, the Government will provide workspace as well as access to a desktop computer and telephone for Contractor needs related to this requirement. (vii)��The Government anticipates award of a firm fixed-price contract for this acquisition, and the anticipated period of performance is: Base Year - 12/09/2022 � 12/08/2023 Option Year 1 - 12/09/2023 � 12/08/2024 Option Year 2 �- 12/09/2024 � 12/08/2025 (viii)� The provision at FAR 52.252-1, Solicitation Provisions Incorporated by Reference (Feb 1998), applies to this acquisition. (xiv)� Responses to this solicitation must include sufficient information to establish the interested parties� bona-fide capabilities of providing the product or service. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s), product description, and any other information or factors that may be considered in the award decision. Such factors may include: past performance, special features required for effective program performance, trade-in considerations, probable life of the item selected as compared with that of a comparable item, warranty considerations, maintenance availability, and environmental and energy efficiency considerations. The Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response.
