- The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of the Enforcement & Removal Operations (ERO), New York Field Office intends to award a fixed-price contract on a sole source basis to Global Tel-Link Corporation DBA ViaPath Technologies (physical address: 3120 Fairview Pk DR STE 300, Falls Church, Virginia 22042-4571, United States; Unique Entity ID: YU77KY88CA25; and Cage Code: 3UEH2).� ICE Performance-Based National Detention Standards 2011 with 2016 revisions requires that noncitizens held under ICE custody be able to make free calls to the ICE/ERO provided list of free legal service providers for the purpose of obtaining initial legal representation, to consular officials, to the DHS Office of the Inspector General, and to the ICE Office of Professional Responsibility Joint Intake Center. Indigent detainees, who are representing themselves pro se, are also permitted free calls on an as-needed basis to family or other individuals assisting with the detainee�s immigration proceedings.� ICE requires a maximum of 520 minutes of free calls on a monthly basis to each detained non-citizen held in ICE custody at Orange County Jail, New York. The period of performance of this contract will be for a total of 60 months (inclusive of one (1) 12-month base period and four (4) 12-month option periods. There is only one responsible source, and no other supplies or services will satisfy the agency requirement.� ViaPath currently and exclusively provides phone services to Orange County Jail, New York.� No other provider can meet ICE�s requirement for phone services at this facility. The phone services will be acquired in accordance with Federal Acquisition Regulation Part 13, Simplified Acquisition Procedures. This notice is NOT a request for proposals or quotes.� This is a notice of the Government�s intent to issue a sole source award to ViaPath for the required phone services.� Requests for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of whether conducting a competitive procurement is in the best interest of the Government. Interested parties may identify their interest and capability to fulfill this requirement by responding to this Notice of Intent no later than the closing date of this notice by email to John.Kurtz@ice.dhs.gov; no telephone communications will be entertained. The subject line in the email shall state �Response to Notice of Intent � Free Phone Services at Orange County Jail, New York.� All information submitted should support the offeror�s capability to provide the required items and shall be furnished at no cost to the Government. The Government reserves the right to cancel the sole source award.
