- The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisitions Division-Kansas City office intends to award, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with Illumina, Inc., 5200 Illumina Way, San Diego, CA� 92122, for the purchase of a desktop sequencer instrument, software, and support for Whole Genome Sequencing (WGS) of bacteria isolates for various projects supporting the pathogens program at National Centers for Coastal Ocean Science (NCCOS).� This purchase is for the National Ocean Service Cooperative Oxford Laboratory (COL) in Oxford, MD.� NAICS Code:� 334516, Analytical Laboratory Instrument Manufacturing PSC:� 6640, Laboratory Equipment and Supplies Sole Source Justification This particular brand name, herein referred to as �Illumina�, is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. The model instrument required is �Miseq�. This instrument is essential to the research being done by NCCOS at COL using methods that are congruent with FDA and other agency counterparts. If this specific machine isn�t purchased, the data from another type of machine won�t be directly comparable to the data that is produced by partner agencies and institutions and important comparisons and discoveries won�t be possible. �Brand name or equal� cannot be used due to the proprietary nature of Illumina sequencing technology and that they are a sole distributor of the Miseq machine. Other companies make desktop sequencing machines, but these machines cannot use the proprietary technologies that the Illumina machine uses and will render data produced unusable for our needs. Illumina Miseq components are covered under patent US 7,329,860, and Nextera sample preparation kits for the instrument are covered under US Patent Nos. 5,964,443 and 6,437,109. The Miseq instrument is proprietary and not available through any distributors, and is only�available for purchase directly from Illumina. WGS is a highly specialized field with very sophisticated technologies. The only source that has proven to be highly accurate for COL sequencing needs is Illumina, and specifically the Miseq machine that provides adequate coverage of the genomes that COL is sequencing. The level of quality produced by other machines from other companies do not meet the standards required for our analyses and do not allow for comparisons to sequencing done by partner institutions such as FDA. If the purchase was from a source other than this single source, the data would likely become obsolete and unusable in many of our studies that are comparing genomic data to existing data in NCBI and GenomeTrakr databases. Thus, we would have to contract out our sequencing needs to external laboratories and the machine at COL would likely not be used. Special Notice This is the only notice to be posted.� This special notice is not a request for competitive offers and no solicitation package is available. However, firms that believe they can provide the needed equipment and software may submit substantiating documentation in writing within the open period of this notice.� Responses can be sent via e-mail to shelley.neubert@noaa.gov. Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. If no documentation is received, award will be made directly to Illumina, Inc. �� The Buy American Statute applies to this procurement. The Buy American Statute gives preference to domestic end products over foreign products unless an exemption applies. DOC, Eastern Region Acquisition Division requires that all contractors doing business with this office be registered with the System for Award Management (SAM).
