- The Department of Veterans Affairs, Detroit VA Medical Center, NCO 10 Contracting Activity intends to negotiate a sole source contract under Simplified Acquisition Procedures and the authority of FAR 13.106-1 Only one source reasonably available for the following items listed below. The associated NAICS code for this is 334510. The vendor will be Fresenius USA Inc., 920 Winter Street, Waltham, MA 02451. Description of requirements: 2008T HD SYS. CDX W/BIBAG BLUESTAR with CLIC Product Number: 191126 + CL10041001 Quantity: 12 This is a Firm-Fixed Price Procurement. It is the Government's belief that only the proposed candidate possesses the required capabilities to successfully meet this requirement. It is the Government's intention to solicit and negotiate with only this source. This notice of intent is not a request for competitive proposals. It is not a solicitation or request for offers. No solicitation package is available. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses must be received no later than 12:00pm (EST), July 20, 2022, referencing 36C25022Q0855. No telephone calls will be accepted for this notice. LouAnn Gilliland Contract Specialist louann.gilliland@va.gov DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-22-AP-5278 Contracting Activity: Department of Veterans Affairs, VISN 10, Network Contracting Office in Kettering, Ohio has been requested by the John D. Dingell VAMC, Detroit, MI to procure 12 Hemodialysis Machines. The 2237 number is 553-22-3-7730-0108 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: 12 Fresenius 2008T HD SYS. CDX W/BIBAG BLUESTAR with CLIC, which will filter waste products from the veteran s blood. Estimated Cost: Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: No alternative Hemodialysis equipment is available that will meet the needs of the service except Fresenius. Service has CyberRen Information System and only Fresenius Hemodialysis equipment will integrate with the CyberRen Systems. Description of market research conducted and results or statement why it was not conducted: VIP was queried using NAICS Code 334510, which provided 186 SDVOSB/VOSB vendors that could potentially provide this equipment. However, when the key word Hemodialysis was added to the search, it provided no vendors able to provide this equipment. GSA, FPDS, eCMS, and SCMC were all searched for past purchases and/or alternative items and this research was unsuccessful for alternative items. However, a past procurement (36C25022P0935) was discovered and found no substitutes for this equipment and no SB vendors were available to provide this specialized equipment. Therefore, the VA Rule of Two cannot be met with this procurement. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
