- VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under $250K VHAPM Part 806.3 Other than Full and Open Competition Page 1 of 1 Original Date: 08/30/17 DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C250-22-AP-3709 Contracting Activity: NCO 10 Contracting Activity (6150 Oak Tree Blvd Independence, OH 44131). The 2237 for this procurement is 541-22-4-5746-0133 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This activity proposes to solicit with the Enrich Products, a small business using sole source procurement procedures under NAICS Code 221310 to provide an EPA registered copper-silver ionization system for the control of Legionella Remediation in the cold and hot water systems at the Cleveland VA Medical Center. The contract will be a Base Year with Four One Year Options. The period of performance of the base year will be from 8-1-2021 through 7-31-2022. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Louis Stokes Cleveland Department of Veterans Affairs Healthcare System is requesting VISN 10 Contracting Activity to enter into sole source procurement with Enrich Products to complete the above stated service agreement. This request is being entered as a sole source because of the nature of the system. Because the Cleveland VA currently has piping in place to accept copper silver systems, Enrich Products is the only one contractor that can directly fit into the current hard piped water lines. This request is being entered as a sole source because the purchase of a different system would add additional cost and down time to the Cleveland VA Medical center may not fit in the current hard piped water lines. Description of market research conducted and results or statement why it was not conducted: FAR 13.106-1-VIP was queried under NAICS Code 221310, and no SDVOSB and VOSB contractors were identified. All repairs and testing must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts. Vendor must exhibit and be authorized the ability to complete all operational modifications according and under manufacturer specifications. Therefore, the VA Rule of Two could not be met. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
