Attachment 1: Request for SDVOSB/VOSB Sole Source Justification Format >SAT Effective Date: 02/01/2022 Page 1 of 4 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C247-22-AP-3786 Contracting Activity: Department of Veterans Affairs, VISN 07, Central Alabama Veterans Health Care System, Atlanta VA Medical Center, 1670 Clairmont Rd., Decatur, GA 30033. The 2237 number 508- 22-3-528-0093. Nature and/or Description of the Action Being Approved: This activity proposes to negotiate a non-competitive award (sole-source) with Unique Cleaning Service Inc. dba Unique Cleaning Service (a Service-Disabled Veteran-Owned Small Business), for a short term six -month interim bridge procurement of Janitorial Services for the Atlanta VA Medical Center. The interim six -month bridge contract is needed due to a protest filed. Due to the urgent need for services caused by the protest, the sole source contract is needed until a long-term contract award can be made. The estimated value for this acquisition is months. and the period of Performance is (6 ) six Description of Supplies/Services Required to Meet the Agency s Needs: An interim six -month bridge contract to provide Janitorial Services to clean approximately 127,000 square feet of building space, to include cleaning the entrances and waste removal at the Atlanta VA Medical Center, 1670 Clairmont Rd., Decatur, GA 30033. Areas are as follows: Ground floor (Bldg. A, B & C) = 27,494SF General Hallways (12,967sf) Restrooms (718sf) Stairwells (482sf) Elevators (828sf) General Mental Health (12499sf) First floor (Bldg. A, B & C) = 52,532SF Veterans Canteen Service (8,944sf) Medical Clinic (8191sf) Platinum Clinic (1st and 2nd floor) (7,282sf) General Hallways (25,199sf) Restrooms (1,879sf) Stairwells (284sf) Elevators (753sf) Third floor (Bldg. B) = 17,039SF 6th floor (Bldg. C) = 14,632 11th floor (Bldg. C) = 14,632 All services will be provided at 1670 Clairmont Road, Decatur, GA 30033 location. The contractor shall furnish all personnel, transportation, and services to provide sanitation, cleaning, and janitorial services as expressly set forth in this Firm Fixed Price (FFP) contract. All equipment and supplies will be provided by the Atlanta VA Health Care System. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below: ( x ) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or IAW VAAR § 819.7007 Sole source awards to service-disabled veteran-owned small business concerns (b), The contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. A notice will be publicized as required by Subpart 5.2 ( ) 819.7008 Sole source awards to a verified veteran-owned small business Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAAR 819.7007 states explicitly, A determination that only one SDVOSB can meet the requirement is not required, and that using this authority, the following must be verified: The anticipated award price of the contract (including options) will not exceed $5 million. The estimated value is and does not exceed $5M. The justification prepared pursuant to FAR 6.302-5(c)(2)(ii) is posted in accordance with FAR subpart 5.301(d). This J&A will be posted on Contract Opportunities. The SDVOSB concern has been determined to be a responsible source with respect to performance; and Unique Cleaning Service Inc. dba Unique Cleaning Service is a registered and verified Service- Disabled Veteran-Owned Small Business (SDVOSB), Unique Cleaning Service Inc. dba Unique Cleaning Service, have an ongoing awarded contract number 36C24720P1075 with the Charlie Norwood VA Medical Center for the same required services in the amount of $3,180,320.00, this is an implementation that the vendor can provide the services and is familiar with the tasks for this effort. Failure to sole source to Unique Cleaning Service Inc. . will prevent Atlanta Janitorial Services from having the support that is required to meet the priorities and safety goals for the patients at the Atlanta VA Medical Center and effectively respond to Veteran s needs. In the estimation of the contracting officer, contract award can be made at a fair and reasonable price that offers best value to the Government. A similar award for this kind of service was made under competitive procedures with pricing from multiple contractors that were found acceptable at the time of award. Pricing will be verified using the IGCE, historical data of pricing from previous orders of this kind and technical expertise. A fair and reasonable price determination will be made prior to award. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: IAW VAAR § 819.7007 Sole source awards to service-disabled veteran-owned small business concerns (b), The contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. A notice will be publicized as required by Subpart 5.2. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: No award shall be made until the Contracting Officer determines the cost to the Government to be fair and reasonable. This determination will be based on a comparison of similar contract pricing, past proposal submissions (if available), other information made available, and an Independent Government Cost Estimate. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted and Unique Cleaning Service, Inc has been determined to be a responsible source with respect to performance. The vendor met the eligibility criteria outlined in VAAR 819.7003, they are registered and certified in VetBiz.gov as a SDVOSB with the NAICS code for this requirement which in accordance with Public Law 109-461 Section 502(c) meets the requirements of this statute to sole source to a SDVOSB. In addition, a review of their Representations and Certifications was conducted in the System for Award Management (SAM) and Unique Cleaning Service, Inc represented that they are an SDVOSB, and the action is below the $5M threshold. Any Other Facts Supporting the Use of Other than Full and Open Competition: In accordance with Public Law 109-461, codified at 38 USC § 8127, in order to increase contracting opportunities for small business concerns owned and controlled by veterans and small business concerns owned and controlled by veterans with service-connected disabilities, contracting officers of the VA are given specific statutory authority to award a contract to a small business concern owned and controlled by veterans using procedures other than competitive procedures (i.e. a sole source contract). The contracting officer may do so in accordance with VAAR 819.7007. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP: Contracting Officer or Designee s Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. One Level Above the Contracting Officer (Required over the SAT but not exceeding $750K): I certify the justification meets requirements for other than full and open competition.
