Synopsis:� Notice of Intent to Award a Sole-Source Contract Announcement Number: 1333MF2-22-Q-02307 Project Title: Biomark PIT tags and PIT tag readers The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Protected Resources (OPR), intends to negotiate on a sole source basis, under the statutory authority of FAR 13.106-1(b)(1)(i), with Biomark, Inc. for PIT tags and PIT tag readers. The required deliverables will permit OPR to acquire data to monitor and assess the status and trends of each sea turtle species. The North American Industry Classification Code (NAICS) for this acquisition is 334511, Search, Detection, Navigation, Guidance, Aeronautical, And Nautical System and Instrument Manufacturing, with a business size standard of 1,250 employees. Sole Source Justification This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. Biomark is the sole distributor of the model of PIT tags and PIT tag readers proven to work successfully in the marine and sandy environment for sea turtle research projects, including stranding networks, and used extensively by other sea turtle researchers in the United States and other countries. Sea turtles are a migratory species and a single sea turtle may be encountered in multiple locations within the United States as well as in other countries. It is imperative that there is consistency and accuracy in searching for and reading/decoding implanted PIT tags. Generally, readers available do not have �universal� capability. They are designed to detect a limited number of frequencies and code structures. Biomark Inc. produces �universal� readers that can detect and read virtually any previously manufactured PIT tag. Biomark Inc. PIT tags and PIT tag readers have a proven track record for use in sea turtles. Biomark Inc. also has a proven track record of reliability and their equipment has successfully performed in long-term tagging studies of marine turtles around the globe. Ensuring that sea turtles are correctly marked and identified for the long-term will assist NMFS in meeting its federal Endangered Species Act (ESA) mandates to conserve and recover sea turtles. The ability of a reader to detect and read a tag depends on its ability to read different frequencies and code structures. The required PIT tags and readers must be compatible in all aspects (form, fit, and function) with existing PIT tags and readers. Biomark is uniquely qualified to meet the requirement. Changing products would require a large amount of time, research, effort and funding to capture and essentially re-tag all sea turtles. Switching to a differently manufactured product would render the existing tracking system and research unusable. The tremendous resources to purchase, tag, track and reconfigure could not be recovered by procuring another manufacturer�s product. Special Notice This special notice is not a solicitation for competitive quotes, nor will one be posted on Contract Opportunities.� However, if an interested party believes that it is capable of meeting the requirements and be in compliance with the above justification, they may submit substantiating documentation in writing within the open period of this notice.� Responses can be sent via e-mail to natasha.thieman@noaa.gov.� Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice.
