- The Department of Health and Human Services, National Institutes of Health, National Cancer Institute (NCI), Center for Cancer Research (CCR), Surgery Branch Flow Cytometry Facility plans to procure, on a sole source basis, BD FACSymphony A3 analyzer from: DB Biosciences Business Unit� One Becton Drive Franklin Lakes, NJ 07417 The response close date of the notice for this requirement is in accordance with FAR 5.203(b). This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.106-1(b)(1), and in accordance with FAR 13.501; and is exempt from the requirements of FAR Part 6. The North American Industry Classification System code is 334516 for which the small business size standard is 1,000 employees. � The BD FACSymphony A3 analyzer, is the only equipment that has the same specifications, interfaces, and configurability as the existing analyzer utilized by NCI�s Surgery Branch Flow Cytometry Core Facility. As such, it�s the only equipment able to meet the Government�s need for an analyzer meeting the same specifications needed to meet researchers demand, and to provide a back-up system that generates scientifically comparable data when one machine is not operational due to maintenance or repairs. � Becton, Dickinson, and Company (BD) is the sole manufacturer and seller of the BD FACSymphony A3 analyzer. There is no other brand of cell analyzer that is compatible with the existing system utilized by NCI�s Surgery Branch Flow Cytometry Core Facility. As such, no other brand of equipment can meet the Governments requirements. � This notice is not a request for competitive quotation. However, if any interested party, especially a small business, believes it can meet the above requirements, it may submit a proposal or quote for the Government to consider. The response and any other information furnished must be in writing and must contain sufficient details to allow NCI to determine if the party can perform the requirement. �All responses and questions must be sent via email to Contract Specialist, John Russell, at john.russell3@nih.gov by no later than 12:00 PM EST, on Wednesday, May 24, 2022 (05/24/22). A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, Contractors must be registered and have valid certification through SAM.GOV.
