VHAPG Part 813.5 Simplified Acquisition Procedures for Certain Commercial Items Attachment 1: Request for Sole Source Justification Template >SAT-$7.5M under FAR13.5 Last Updated: 02/01/22 Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5 Acquisition Plan Action ID: 36C260-22-AP-2293 Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 20, for the VA Puget Sound Healthcare System, Seattle & Tacoma Washington. Purchase request number 663-22-3-9993-0051. Nature and/or Description of the Action Being Processed: This procurement is for a short- term ground ambulance contract. In accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6 but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: The VA Puget Sound Healthcare System requires a short-term ground ambulance contract that will allow NCO 20 time to compete and award a long-term contract. Ground ambulance services are critical in the support of Puget Sound Veterans, and without this short-term contract patient care could suffer. The estimate for this short-term contract is $740,801.94. The period of performance is May 1, 2022 through Oct 31, 2022. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. ยง 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below: ( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (X) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): American Medical Response (AMR) Ambulance Services has been providing ground ambulance services for the VA Puget Sound Healthcare System on the current and previous contracts. They have the required ambulance vehicles, resources and trained/certified parmedics & EMT s to meet the Governments requirements as of May 1, 2022. They are registered in SAM.gov with no exclusions and have satisfactory or higher past performance ratings. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the current contract expiring on Apr 30, 2022, there is only one source capable of providing this service starting on May 1, 2022. Aside from limited market research performed in accordance with FAR Part 10, no other efforts were taken to solicit from additional sources. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The price quote from the Contractor will be compared to previous contract ambulance rates, as well as the Independent Government Estimate to ensure price reasonableness is established. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Limited market research was conducted in accordance with FAR Part 10, results of which showed only one Contractor capable of satisfying the requesting office s requirement. Any Other Facts Supporting the Use of Other than Full and Open Competition: Not applicable. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: American Medical Response (AMR) Ambulance Services. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Upon award of this short-term contract, the NCO 20 Contracting Office will compete and award a new long-term contract for ambulance services. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs. The supporting data under my cognizance, included in the justification, are accurate and complete to the best of my knowledge and belief.
