Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 ""Synopses of Proposed Contract Actions."" U.S. Army Corps of Engineers, Walla Walla District intends to solicit a firm-fixed price construction contract to rehabilitate the McNary Drainage, Unwatering, and Equalization (DUE) System. The DUE system is located at the McNary Lock and Dam Project in Umatilla, Oregon. The work consists of replacing all unwatering and drainage pumps to include all non-embedded intake and discharge piping as well as all isolation valves. Diving in the tailrace will be required to temporarily plug the unwatering pump discharge piping while isolation valves are replaced. The three unwatering pumps will be converted from 4160V to 480V with the installation of new transformers and motor control centers. Work within the unwatering and drainage sump will require the setup of temporary pumping to install new pump intakes and seismic bracing. The proposed action will contain a brand-name description to specify a particular brand-name product peculiar to one manufacturer in a portion of the acquisition. The particular brand-name product to be specified are Sulzer unwatering pumps to be rehabilitated by Sulzer. � No other unwatering pumps are compatible with the DUE system to be rehabilitated in this contract, therefore, the use of the brand-name description in the acquisition is essential to the Government�s requirements, thereby precluding consideration of a product manufactured or rehabilitated by another company. These brand-name unwatering pumps can be rehabilitated only by Sulzer.� The statutory authority for this acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1(c), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, application for brand name descriptions. The Government intends to solicit this action in June 2022. The NAICS code is 237990, Other Heavy and Civil Engineering Construction. The size standard as defined by the U.S. Small Business Administration is $39.5 million. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR BIDS. Interested concerns must show clear and convincing evidence that competition of this portion of the requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 12:00 PM Local Time on the notice end date, a solicitation will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government to include the brand-name product in the solicitation is solely within the discretion of the Government.
