- NON-COMPETITIVE COMBINED SYNOPSIS / SOLICITATION Title: SARS-CoV-2 Spike AlphaLISA assays (Covid-19 Action) RFQ: 75N95021Q00403 �(i)������� This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii)������� The solicitation number is 75N95021Q00403 and the solicitation is issued as a request for quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures and FAR Part 12�Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), NIDA Office of Acquisitions � NCATS Section, on behalf of the National Center for Advancing Translational Sciences (NCATS), intends to negotiate and award a firm-fixed price purchase order without providing for full and open competition (including brand-name) to PerkinElmer Health Sciences, Inc., 710 Bridgeport Ave., Shelton, CT 06484-4750, to purchase SARS-CoV-2 Spike AlphaLISA assays. The anticipated award date is on or around September 10, 2021. This acquisition is non-competitive. NCATS previously purchased assay development and reagent production services from Perkin Elmer for the same reagents required for this procurement for its ongoing COVID-19 research projects. The reagents were validated to work in live virus assays and additional reagents are needed for the completion of the drug repurposing screening. The Contractor shall provide only the reagents to NCATS, not compounds (typically defined as small molecules). NCATS will use the analysis of comparability to ensure that the reagents perform similarly to those provided previously by the contractor. The Spike AlphaLISA Assays are essential to avoid disruption and ensure continuity of the research and therefore limits the availability to a sole source. Only this suggested source can furnish the requirements, to the exclusion of other sources, because the Spike AlphaLISA Assays that NCATS requires have previously been used by its scientists and researchers in its current COVID-19 research project being conducted. Additional reagents of the same batch is required to ensure consistency and avoid possible disruption and delays in its research and outcomes for the completion of NCATS drug repurposing screening. (iii)������ The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-06 dated July 12, 2021. (iv)������ The associated NAICS code is 325413 In-Vitro Diagnostic Substance Manufacturing and the small business size standard is 1,250 employees. This acquisition is not set aside for small business. (v)������� Requirement ����������� The National Center for Advancing Translational Sciences (NCATS) requires the procurement of these reagents for SARS-CoV-2 drug repurposing screening. NCATS requires confirmation that the reagents that are produced by the contractor perform comparably to those purchased previously by NCATS for its SARS-CoV-2 drug repurposing screening.� Contractor is required to evaluate the reagents they produce to ensure that their performance is comparable to what they have produced previously. ����������� NCATS had previously purchased assay development and reagent production services from Perkin Elmer for the same reagents required in this purchase order in support of Covid-19 research. The reagents were validated to work in live virus assays and more reagents are required for completion of drug repurposing screening. The contractor is to deliver only reagents to NCATS, not compounds (typically defined as small molecules). NCATS� objective is to use the reagents provided by the contractor to conduct drug repurposing screening. NCATS will use the analysis of comparability to ensure that the reagents perform similarly as those provided by contractor before. ����������� Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the Statement of Work below: The Contractor shall provide the following which NCATS will conduct drug repurposing screening. Contractor is not required to use the reagents for anything other than� a small comparability study that compares the data from these reagents to data produced in prior batches. �� � � � � � � � � � � CLIN 00001���������� Custom SARS-CoV2 Spike S1 AlphaLISA assay Includes QC and reproducibility 8 x 1,000 tests in 80uL final volume The Contractor shall test the performance of the reagents is in line with previously delivered AlphaLISA Spike assay reagents (75N95021P00034). The Contractor shall provide directions and guidance for use of the reagents in order for them to perform similarly as with the previous batch of reagents described in 2) above. For complete requirements please refer to Attachement 1 � Statement of Work. (vi)������ Delivery shall be thirty (30) days After Receipt of Order (ARO). Delivery shall be FOB Destination and shall be made to: National Center for Advancing Translational Sciences (NCATS) 9800 Medical Center Drive Bldg C / Room 313W Rockville, MD 20850 (vii)����� The provision at FAR clause 52.212-1, Instructions to Offerors � Commercial Items, applies to this acquisition. (viii)���� FAR 52.212-2 Evaluation-Commercial Items (Oct 2014) (a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: technical capability of the item offered to meet the Government requirement; price; past performance Technical and past performance, when combined, are significantly more important than cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer�s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (d) Respondents to this solicitation must identify any exception to Section 508 requirements. This synopsis is not a request for competitive proposals. All responsible sources may submit a bid, proposal or quotation which shall be considered by the agency. The following additional contract requirement(s) or terms and conditions as determined by the contracting officer are necessary for this acquisition and consistent with customary commercial practices. There are no additional contract requirement(s) or terms and conditions applicable to this acquisition The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement. Responses to this solicitation must include clear and convincing evidence of the offeror�s capability of fulfilling the requirement as it relates to the technical evaluation criteria.� The price proposal must include the labor categories, an estimate of the number of hours required for each labor category, fully loaded fixed hourly rate or each labor category, breakdown and rationale for other direct costs or materials, and the total amount. Any resultant award made from this solicitation shall include the following language required for all COVID-19 procurements: HHS reserves the right to exercise priorities and allocations authority with respect to this contract, to include rating this order in accordance with 45 CFR Part 101, Subpart A�Health Resources Priorities and Allocations System. Any resultant award shall include the following language: Please be advised that the National Center for Advancing Translational Sciences (NCATS), National Institutes of Health (NIH) is a Federal agency. Your mass-market commercial sales and/or license agreement terms and conditions may include provisions that are customarily found in the commercial sector but which are not enforceable under a contract with a Federal agency.
