- Special Notice Number: NFFN7400-21-02632 Agency: Department of Commerce Office: National Oceanic and Atmospheric Administration (NOAA) Location: National Marine Fisheries Service, Southeast Fisheries Science Center (SEFSC). The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration�(NOAA), National Marine Fisheries Service (NMFS), Southeast Fisheries Science Center�(SEFSC) intends to award, on a sole source basis, under the authority of FAR 13.106-1(b)(1), to�Johnson Controls, Inc, the sole service contract provider that can provide service maintenance�for all HVAC equipment and Metasys operating systems and replacement of the variable�frequency drive(VFD).� The sole source determination is based on the National Oceanic and�Atmospheric Administration�s (NOAA), National Marine Fisheries Services SEFSC�requirement for a service contract for the HVAC maintenance and equipment repair as the�MetaSys is proprietary to Johnson Controls, Inc.� They are the only source capable of�providing services to the system and would have to be involved for any of the component�maintenance.� The required service must be compatible in all aspects (form, fit, and function)�with existing systems and equipment, and the source is uniquely qualified to meet the�requirement. The Estuarine Habitats and Coastal Fisheries Center (EHCFC) was constructed�in 1998.� Johnson Controls installed the physical plant management system during�construction, and set operations of the Metasys physical plant management system.� The period of performance is 10 days from award for 3 months, with three (3) option periods.� The Government intends to negotiate a firm fixed price contract.� This Special Notice of intent is not a request for competitive proposals and no solicitation package is available.� However, firms that believe they can fully meet the Government's requirements may submit substantiating documentation in writing.� Submissions are due no later than August 25, 2021 at 3:00 p.m. Eastern Standard Time.� Oral communications are not acceptable in response to this notice.� Responses may be emailed to Karen.Beck@noaa.gov.� Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis.� A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. It is the Government's belief that only Johnson Controls Inc., has the sole capability of providing the requirement stated above. �
