Brown III� Email:� William.t.brown68.civ@mail.mil�� Phone:� 801-432-4273 DESCRIPTION: *****THIS REQUIREMENT IS BEING SOLICITED AS A TOTAL SMALL BUSINESS (SB) SET-ASIDE *** The Utah National Guard is soliciting a requirement for Medical Surveillance Exam Testing under combined synopsis/solicitation W911YP21R0016 and is being issued for Request for Quotations (RFQ).� This requirement is being solicited as a Total Small Business set-aside under NAICS code 621999 - �All Other Miscellaneous Ambulatory Health Care Services� which has a Small Business Size Standard of $15 million (https://www.sba.gov/sites/default/files/files/Size_Standards_Table.pdf).� FOR VENDOR�S QUOTES TO BE CONSIDERED, YOU MUST BE REGISTERED IN SAM.GOV AS A SMALL BUSINESS UNDER THIS NAICS CODE OR VERY SIMILAR NAICS CODE.� Furthermore, your company must also demonstrate you have the experience and capability to conduct Medical Surveillance Exam Testing. PERFORMANCE WORK STATEMENT SAFETY & OCCUPATIONAL HEALTH BLANKET PURCHASE AGREEMENT FOR MEDICAL SURVEILLANCE EXAMINATIONS 1. GENERAL This Performance Work Statement (PWS) supports the Utah Army National Guard (UTARNG) Occupational Medical Surveillance Examination Program in accordance with Department of Defense, Occupational Safety and Health Administration (OSHA), and other state and federal regulations. Personnel requiring exams are located throughout the state with the majority located near Camp Williams, Draper, Ogden, Salt Lake City, Spanish Fork, St. George, and West Jordan. �The estimated number of personnel to be examined is 150. �The Government retains the right to increase and/or decrease the number of personnel tested and the locations of service due to military operations. 2. PURPOSE 2.1. The purpose of the UTARNG Mobile Occupational Medical Surveillance Examination Program is to provide job-related medical surveillance examinations and occupational health services to the UTARNG full-time support, Federal Military and Civilian Technicians. �This PWS does not provide services for Utah State employees, emergency hires, Active Guard Reserve (AGR), Title 10 or M-Day Soldiers, or civilian contractors. �The examinations shall include personnel assigned to positions requiring specific standards of physical fitness. 3. PROCEDURES and STANDARDS 3.1. This is a non-personal, health services contract as defined in FARS Subpart 37.101 under which the contractor is an independent contractor. �In accordance with FAR Subpart 37.4, Nonpersonal Health Care Services, the Government may enter into a non-personal health care services contract with physicians and other health care providers under authority of 10 U.S.C. 2304 and 41 U.S.C. 253. Under FARS Subpart 37.4, the government may evaluate the quality of professional and administrative services provided, but retains no control over the medical, professional aspects of services rendered. �All professional judgments, medical diagnoses, and treatment plans, remain under the control of the contractor. 3.2. The Contractor will indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance. �The Contractor will maintain medical liability insurance in a coverage amount acceptable to the Contracting Officer which is not less than the amount normally prevailing within the local community for the medical specialty concerned. �The Contractor will ensure subcontractors used for provisions of health care services, if any, will abide by the requirements of clause 52.237-7, Indemnification and Medical Liability Insurance, including the maintenance of medical liability insurance. 3.3. The Contractor shall ensure all procedures are conducted in accordance with applicable American Board of Occupational and Environmental Medicine (ABOEM) and/or American College of Occupational and Environmental Medicine (ACOEM) standards, American Association of Occupational Health Nurses (AAOHN), U.S. Department of Labor, Occupational Safety and Health Administration (OSHA), and the National Institute for Occupational Safety and Health (NIOSH) Standards. 3.4 The Contractor will provide all labor, supervision, tools, materials, equipment, and incidentals required to conduct the Medical Surveillance Examinations/Occupational Health Services for the Government. 3.5. In the event of contractor equipment failure, specific testing and/or specific examinations not completed during the testing period will be completed at a scheduled time mutually convenient to the Contractor and the UTARNG. 3.6. The Contractor will provide board certified or board eligible Occupational Medicine Physician(s) (MD/DO) to conduct job-related medical surveillance physical examinations and occupational health consultation services. 3.7. The Contractor will provided certified/licensed medical technicians to administer medical surveillance screening/testing. 3.8. The Contractor will ensure all clinical laboratory/chemistry services are performed by personnel certified by the American Society of Clinical Pathology (ASCP) in CLIA accredited laboratory(s) as defined by the Department of Health and Human Services (DHHS) Clinical Laboratory Improvement Amendments (42 USC 263a). �The supporting laboratory(s) will provide, at no additional cost, employee instruction and all equipment necessary for tests requiring special collection methods and/or containers. �The Contractor will identify employees requiring counseling due to laboratory results and will document counseling performed by the examining provider. �The Contractor will provide a copy of lab results to employees to review with their primary care physicians as needed. 3.9. The Contractor will ensure health care workers comply with the privacy requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). 3.10. The Contractor will ensure instrumentation meets or exceeds appropriate performance standards, and accuracy must be verified in accordance with current Occupational Medicine Certification standards. 3.11. Examinations to be provided are Occupational Health annual medical surveillance exams to include vital signs, audiograms and vision screenings, respirator physical clearance exams, respirator fit tests, spirometry, and laboratory testing. 3.12. The Contractor will provide vital signs to include height, weight, body mass index (BMI), blood pressure (BP), and pulse rate. �Deviations outside of the accepted, normal range for BMI, BP, and pulse will be reported. 3.13. The Contractor will be knowledgeable of 29 CFR 1910.95, Occupational Noise Exposure, regulations and requirements for hearing conservation and readiness. �Personnel conducting audiometric testing will be certified by a Council for Accreditation in Occupational Hearing Conservation (CAHOC) approved program. �The Contractor will provide all audiogram results specifying those with significant threshold shifts (STS) and/or any OSHA reportable hearing losses to the OHN. 3.14. The Contractor will ensure personnel conducting Pulmonary Function Tests (PFTs) are certified by a NIOSH approved program and results are reviewed by a licensed physician, Certified Pulmonary Function Technologist, or Registered Respiratory Therapist in accordance with 29 CFR 1910.1001. a. PFTs will be performed only on those employees exposed to workplace respiratory hazards, who require the use of a respirator, and are identified as requiring a PFT by the State OHN. b. The test will include at a minimum, Forced Expiratory Volume in one second (FEV1), Forced Vital Capacity (FVC), and FEV1/FVC ratio, comparison with recognized standard results for the individual�s height and weight, and a documented interpretation by a pulmonologist or certified OH physician (MD/DO). c. Specifications regarding equipment guidelines and calibration, test administration, and test interpretation must meet applicable OSHA, ANSI, NIOSH, and ATS-ERS testing requirements. 3.15. The Contractor will provide medical evaluation for employees who wear respirators and will perform quantitative fit testing in accordance with 29 CFR 1910.134, App A. a. Individual masks/respirators will be provided by the employees. 3.16. The Contractor will perform vision screenings using multiphasic vision screening equipment to measure the following primary visual skills bilaterally: a. Near and far visual acuity b. Vertical and lateral phorias c. Stereo vision depth perception d. Color perception (Ishihara or comparable test) e. Peripheral vision 4. REFERENCES 4.1. The Contractor will provide healthcare workers with the appropriate PPE such as, but not limited to, gloves, protective eyewear, gowns or aprons, masks, and face shields, where the potential for exposure to hazards may exist in accordance with 29 CFR 1910.132, General Requirements (Personal Protective Equipment). 5.2. Contractor shall ensure each healthcare workers comply with the requirements of 29 CFR 1910.1030, Blood borne Pathogens Standard. 6. INFECTIOUS WASTE DISPOSAL 6.1. Disposal of all infectious waste shall be in accordance with local, state, and federal regulation and disposed of by the contractor unless other accommodations have been coordinated in writing. 6.2. Contractor shall ensure puncture resistant sharps containers are readily accessible to healthcare workers and located in all treatment areas where sharps could potentially be used. 7. MEDICAL REPORTS AND RECORDKEEPING 7.1. The Contractor will ensure each employee signs the Privacy Act Statement (DD Form 2005) during the registration process. 7.2. The Contractor will notify the OHN of any medical surveillance results falling outside of normal limits and of results potentially requiring follow-up care. The Contractor will confirm abnormal clinical findings by repeat analysis at no additional charge. Confirmed results will be reported to the Occupational Health Nurse by telephone at 801-432-4906. If abnormal findings are due to Contractor error, the test will be repeated at no additional charge. 7.3. The Contractor will notify local Emergency Medical Services by telephone at 9-1-1 of any emergent issue identified that presents a danger to life, limb, or sight. After calling for assistance, the Contractor will notify the Occupational Health Nurse by office telephone at 801-432-4906 or by cell at 321-626-8011. 7.4. The Contractor will administratively organize and send all employee medical results and records generated to include but not limited to all diagnostic tests, graphs, charts, reports, questionnaires, waivers, employee consent forms, physical findings, and examination results to the State OHN by confidential, encrypted email at carrie.c.papproth.mil@mail.mil or by postal mail at the following address within TEN (10) working days of examination completion: Utah Army National Guard DAS Safety and Occupational Health Office ATTN: Carrie Papproth, OHN 12953 S Minuteman Drive, Draper, UT 84020 7.5. The Contractor will under no circumstances provide individual employee�s medical information results to Supervisors or any other representative of the Employer other than the OHN in accordance with The Privacy Act of 1974. �The Contractor may confirm date and time of appointment and attendance of appointment with supervisor. 8. EXAMINATION SCHEDULING 8.1. Scheduling will be initiated by the State OHN or in some situations, by the employee to be seen, via telephone call to the appropriate clinic site. �Employees will be instructed to appear thirty minutes prior to their appointment time to check in and fill out any applicable paperwork. �Employees will bring exam forms, Privacy Act Statement DD Form 2005, and respirator, if applicable, with them to their appointments. 8.2. In the event of a Contractor equipment failure or other unforeseen event, specific testing and/or parts of examinations that are not completed during the scheduled exam shall be completed at a scheduled time mutually convenient for the Contractor, OHN, and the specific clinic. �Unfinished testing or examinations will be completed at no additional cost to the Government. �The option to schedule physicals not completed due to equipment failure, through a local occupational medical facility shall be done at no cost to the Government. �The Contractor shall be directly responsible to cover costs for completing these make-up exams. 8.3. In the event of a no call/no show by an employee, the Contractor will notify the OHN at the time of the missed appointment and the employee will be rescheduled at no cost to the Government. 9. SERVICE DELIVERY SUMMARY (SDS) 9.1. The service delivery summary is designed to be a concise statement of key deliverables which are measured to determine the contractor's performance success or failure. ����������� PERFORMANCE GOALS� ������ PERFORMANCE SCHEDULE �Insurance & Licensed and/or Certified staff ll physicians and technicians 100% of the time (see Para 3.2, 3.3, 3.6, 3.7, 3.13, 3.14) �Equipment Certification Instrumentation meets or exceed performance standards 100% of the time (see Para 3.4, 3.10, 3.14c) �Medical Surveillance All new, retiring or terminated, and employees requiring periodic exams have been examined 98% of the time (see Para 3.11) �Infectious Waste Disposal All sharp instruments and potential bloodborne pathogens are handled and disposed of IAW Federal, State, and local regulations 100% of the time (see Para 6.1 and 762) �Medical Reports and Recordkeeping Privacy Act Statement for each employee seen and the material generated from the exams are submitted in a timely manner 100%of the time (see Para7.1, 7.4) QUESTIONS & ANSWERS 1.� Section 1 states 7 locations where Technicians are located. Are the exams to take place at each location, a single location or just some of the locations? How many PAX per location?� Exams are conducted in 3 locations to capture the most technicians possible and to cut down on travel. The locations are Draper, Spanish Fork, and West Jordan. However, if a vendor has locations near ours, that�s a possibility, as well. I�m not certain what the abbreviation PAX stands for. Patients per? That varies.� 2.� Can exams be completed by a PA/NP and signed off by a Occ Health MD/DO?� Yes 3.� The PWS states Lab testing, but does not state specific lab tests, or quantity of technicians requiring each lab. Can this information be provided?� BLL and ZPPs for approximately 12 Technicians; heavy metal panels TBD but not to exceed 20 4.� Can an estimated number of PFTs to be performed be provided and per location?� After COVID, we�ll be requesting PFTs on all of our respirator wearers. Not to exceed 100 per location. 5.� Can the government provide CLIN structure?� Shall pricing be all inclusive or broken down by each exam/test type?� CLIN structure will be all inclusive CLINs per year. 6.� Can services be provided inside government buildings, with the exception of the hearing?� They could, but the preferable method is a stand-alone mobile unit. 7.� Are there outside outlets available for a mobile hearing trailer?� Unknown at this time. Will need to verify for all three locations. SET-ASIDE / FAR REGULATION: Any award resulting from this solicitation will be made using a TOTAL SMALL BUSINESS set-aside order of precedence as follows: In accordance with FAR Subpart 19.502-2 Total Small Business Set-Aside Procedures, any awards under this solicitation will be made on a competitive basis first to small business concerns in accordance with FAR 19.502-2.� If there are no acceptable offers from small business concerns, the set-aside shall be withdrawn and the requirement, if still valid, will be made on the basis of full and open competition considering all offers submitted by responsible business concerns. BLANKET PURCHASE AGREEMENT / EVALUATION CRITERIA:� The procurement vehicle for this effort will be a 5-year Blanket Purchase Agreement (BPA) with estimated period of performance dates between 1 JULY 2021 � 20 JUN 2026.� Award will be based on an all or none basis using lowest price technically acceptable (LPTA) evaluation criteria.� For proposals to be technically acceptable, it must meet all the specifications outlined in the PWS and indication of past performance experience relating to conducting Medical Surveillance Exam Testing. Relevancy and currency will be used for past performance criteria and only a rating of ACCEPTABLE, NOT ACCEPTABLE, OR NEUTRAL will be given on past performance.� If a Contractor has no relevant past performance, the Contractor will not be rated Favorably or Unfavorably but will be rated Neutral and not have that count against them.� An LPTA quote is one that meets all the technical aspects outlined in this solicitation and PWS while being the lowest price quote, IAW FAR 15.101-2. ORDERS: Upon issuance of this Blanket Purchase Agreement, the Contractor may process orders under this BPA through the issuance of individual BPA calls OR may process orders utilizing a Government Purchase Card (GPC) when authorized. The BPA call may include a Delivery Schedule which will break out the units serviced by a particular call, points of contact for the requirement, locations to be served, projected dates of services and projected number of testing authorized by the call. �A BPA call may be issued to support the organizational requirements over a multiple month period of performance. PAYMENT BY GOVERNMENT PURCHASE CARD (GPC): Purchases under this Blanket Purchase Agreement may be made by Government Purchase Card (GPC) as an alternate form of payment when authorized. Terms established by Contractor�s Blanket Purchase Agreement shall be the same regardless of payment method. Advancement of charges is not authorized. Contractor shall not charge the Government prior to delivery of goods or rendering services. Charges shall be made on or after the date of delivery and consolidated into one charge for the total amount. INVOICES: An itemized invoice shall be submitted electronically through Wide Area Workflow (WAWF) located at https://piee.eb.mil/piee-landing/ for each BPA call received when services are performed. �If the BPA call covers multiple units and/or multiple months of performance; The Contractor is authorized to submit multiple invoices against the BPA call by Contract Line Item Number (CLIN). �When the Contractor is submitting an invoice in WAWF, it is critical that the Contractor does not check final invoice against a Contract Line Item Number or the BPA call unless it is the final invoice they will submit against that particular BPA call. �Failure to do this may result in delay of payment. �In addition, draft paper invoices will be emailed to the �Authorized Caller� and Contracting Officer Representative (COR) that initiates the services with the Contractor. �This is to clear up any discrepancies prior to the invoice being entered into WAWF and to help facilitate receipt of services by the Government. �Paper Invoices shall contain the following minimum information: 1)������ Contractor Name, address, and phone number. 2)������ BPA Call number (if applicable). 3)������ Date(s) of delivery. 4)������ Purchase Request reference number (if applicable) 5)������ Quantities delivered, unit cost, and total cost. 6)������ Invoice total amount due. 7)������ The Utah National Guard is a federal government entity, and as such is exempt from all local, state, and federal taxes, including but not limited to sales taxes. Any charges or invoicing that includes taxes shall be disputed/declined by Government, if charged or invoiced by Contractor. ELECTRONIC INVOICING THROUGH WIDE AREA WORKFLOW (WAWF): To meet compliance with DFARS 252.232-7003, Electronic Submission of Payment Requests, all Contractors must submit requests for payment (invoices) through WAWF AND invoice exactly as shown on the BPA call. �Additional information and registration for WAWF can be completed online at https://piee.eb.mil/piee-landing/. �Payment will be made by DFAS office designated in the BPA. �All payments on BPA Calls will be made by electronic transfer of funds (EFT). �The Government will make payment through WAWF upon satisfactory completion of work and proper invoice that permits certification for payment SAM REGISTRATION:� All offerors must have an active registration in System for Award Management (SAM) at time of award in order to be eligible for contract award.� All offerors responding to this solicitation must meet all standards required to conduct business with the Government, including active registration in SAM and WAWF/iRAPT, and be in good standing.� All qualified responses will be considered by the Government.� In addition to providing pricing each quote must include vendor's CAGE/DUNS number, Federal Tax Number, and must include point of contact information.� IAW FAR 52.212-1(k), prospective awardees shall be registered and active in the System for Award Management (SAM) prior to award and be in good standing.� Prospective offerors may obtain information on registration at WWW.SAM.GOV.� IAW FAR 52.204-7 and DFARS 252.204-7004 Alt A, prospective vendors must be registered in the SAM database prior to award.� Lack of SAM registration shall be a determining factor for award and your bid may be disqualified for not being registered and active in SAM.gov.
