- PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED The Department of Veterans Affairs (VA) Veterans Health Administration (VHA) intends to award a sole source contract to Steris Corporation, for providing preventive maintenance and repair services on Sterilizing equipment located at the central AR Veterans Healthcare System, located in North Little Rock, AR. This procurement is being conducted under Federal Acquisition Regulation (FAR) Parts 12 and 13. These VA facilities have a requirement for a contractor to provide all labor, tools, materials, equipment, software, facilities, transportation and supervision necessary to complete all work associated with performing preventive maintenance services, necessary inspections, and repair services, for Steris equipment. Based on market research and previous acquisition history, it has been determined that Steris Corporation is the only vendor capable of providing all the required preventive maintenance and repair services. This notice will be distributed solely through this website. Interested parties are responsible for monitoring this site to ensure they have the most up-to-date information about this acquisition. The Government intends to negotiate with only one source under the authority of FAR 6.302-1. Interested parties may identify their interests and capability to respond to this requirement, to include the documentation required by VA Acquisition Regulation (VAAR) 852.212-72(c) to the attention of: Andrew Misfeldt, email address: andrew.misfeldt@va.gov, no later than Wednesday, May 28, 2021, at 4:30pm (Central Time). Only emailed responses will be considered. Information received will be utilized solely for determining whether to conduct a competitive procurement. A determination not to compete this proposed acquisition based upon responses to this notice is at the sole discretion of the Government. DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID:__36C25621AP3009____________________ Contracting Activity: Department of Veterans Affairs, VISN 16, Central Arkansas Veterans Healthcare Service (CAVHS) Medical Center. Engineering Department. 598-21-3-8317-0057 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Perform service/maintenance and or repairs/preventative maintenance on 5 each CAVHS Sterilization units which includes but not limited to calibrating, adjusting, and replacement of worn or defective parts, and troubleshooting as required. Must be able to meet CAVHS s timelines as for responding to urgent needs detailed out in the SOW. $55,531.00 Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: STERIS is the sole factory-authorized supplier of parts and service for the equipment that they manufacture including products under the brand names of AMSCO®, Finn Aqua®, and HAMO. In addition, based on my market research, Steris is the only company that provides updates to any software and OEM parts that may be required by units owned by CAVHS. These units were purchased from Steris originally and they are the only ones to my knowledge that can maintain them based upon our requirements and needs. All replacement parts manufactured or marketed by STERIS Corporation are compliant with original equipment manufacturer specifications. These parts are sold and shipped directly to the end user of the products. Distributors are not utilized. STERIS has over 950 factory trained personnel who maintain their equipment through preventative maintenance agreements assuring that STERIS-manufactured equipment continues to operate in compliance with O.E.M. specifications. Due to the critical needs of maintaining these sterilization units the contractor must be able to: 1. Respond to requests for routine service within (24) hours. 2. Requests for technical telephone support shall be responded to within (2) hours. 3. Requests for unscheduled repairs shall be responded to within (4) hours of initial phone contact from CAVHS and contractor must be on-site within (24) hours during normal working hours; and same-day service for emergency repairs. 4. Maintain the 5 each CAVHS Sterilization units as directed in the manufacturer s instructions. 5. Have the ability to provide any updates to our software and or parts that may change over time and require them to be replaced with OEM replacement parts. The critical necessity that is required and needed to ensure safe and reliable sterilization units should not be awarded to any such contractor that cannot meet every requirement that is outlined in the Statement of Work (SOW). These units in question ensure the utensils and such are properly sterilized to safeguard against any contamination that could or may occur during normal and emergency operations and procedures. The selection of the vendor needs to be taken extremely serious and with caution. Added to this request is a documented letter stating that Steris is the sole factory-authorized supplier of parts and service See Attachment 1. Description of market research conducted and results or statement why it was not conducted: Market research was conducted by Randolph Smith and Charles Walls outlined in Attachment 6, Market Research Worksheet for Customers; Acquisition Planning SOP; Revision: 02, Effective Date: 3 May 2021. Upon receipt of the requirement VIP was searched for possible vendors and none were found to have Steris certification. The OEM letter is filed that only Steris is allowed to perform any services or repairs as the equipment must be maintained by the OEM to remain in service there is no other option but to use Steris for this PM Service plan. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3.
