Acquire, for the second or subsequent time, directly from the actual manufacturer. AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid. A SAR package contains all technical data needed to demonstrate that the prospective contractor can completely manufacture the item to the same level of quality or better than the Original Equipment Manufacturer (OEM). The onus is on the contractor to document and demonstrate their product is equal to, or better, than the currently approved item which DLA Land and Maritime is procuring. The purpose of this notice is to be obtain information regarding the capability and availability of qualified businesses that are capable of executing this potential contract. The Government is not obligated and will not pay for any information received from potential sources as a result of this notice. Your response to the information requested will assist the Government in determining the appropriate acquisition method. Sources interested in providing an offer on the solicitation, should complete the attached market survey and return the completed copy to Mindy Cook via email at mindy.cook@dla.mil. This item has technical data some or all of which is subject to export-control of either the International Traffic in Arms regulations (ITAR) or the Export Administration Regulations (EAR), and cannot be exported without prior authorization from either the Department of State or the Department of Commerce. Export includes disclosure of technical data to foreign persons and nationals whether located in the United States or abroad. This requirement applies equally to foreign national employees and U.S. companies and their foreign subsidiaries. DFARS 252.225-7048 is applicable to this data. The Defense Logistics Agency (DLA) limits distribution of export-control technical data to DLA contractors that have an approved US/Canada Joint Certification Program (JCP) certification, have completed the Introduction to Proper Handling of DOD Export-Controlled Technical Data Training and the DLA Export-Controlled Technical Data Questionnaire (both are available at the web address given below), and have been approved by the DLA controlling authority to access the export-controlled data.
