Description
This notice is a combined synopsis/solicitation for commercial items using Simplified Acquisition Procedures. This acquisition will be made in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 �Streamlined Procedures for Evaluation and solicitation for commercial Items,� as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation (a written solicitation will not be issued) and quotes are being requested. The Solicitation number is RFQ-RML-2062986 and the solicitation is issued as a Request for Quotes (RFQ). This acquisition will be processed under FAR Part 13 Simplified Acquisition Procedures (SAP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-05 March 10, 2021. The North American Industry Classification System (NAICS) code for this procurement is 562211 - Hazardous Waste Treatment and Disposal, with a small business size standard of $41.5 million. The requirement is being competed full and open competition, un-restricted and with a small business set-aside. The National Institute of Allergy and Infectious Diseases (NIAID) has a requirement for: *PLEASE SEE ATTACHED BILL OF MATERIALS This is a base plus four options years requirement. 05/31/2021 � 05/30/2026 (Base year) 05/31/2022 - 05/30/2023 (Option year 1) 05/31/2023 � 05/30/2024 (Option Year 2) 05/31/2024 � 05/30/2025 (Option Year 3) 05/31/2024 � 05/30/2026 (Option Year 4) Requirements: Price must include all labor, handling, packaging, supplies, manifesting, labeling, transportation, disposal costs, access fees, surcharges, insurance, etc. The waste disposal cycle is semiannually (every 6 months) This service will be carried out, regardless of volume or type of waste to be collected. Location: hazardous waste accumulation area (aka RML Hazardous Waste Shed). Do not disturb portions of site beyond this area. A timeline for final disposal of waste All Contractor personnel who have any responsibility for handling, packaging, manifesting, or transporting hazardous wastes must be properly trained in accordance with all applicable regulatory requirements including OSHA requirements in accordance with 29 Code of Federal Regulations (CFR) 1910.120, DOT requirements in accordance with 49 CFR 172.704 and RCRA requirements in accordance with 40 CFR 264.16. RML wastes under the control of the Contractor shall be properly secured at all times.� Spills or releases resulting from Contractor negligence: The Contractor shall provide, at no cost to the Government, all labor, materials and services for clean-up of all releases (as defined in 40 CFR 302.3) and spills of hazardous wastes due to the negligence of the Contractor, from the point of pick-up to the point of final treatment, storage, recycling or disposal.� The clean-up of spilled or released wastes or materials shall be performed in compliance with all applicable regulations and to the maximum extent possible to return the contaminated area to its original condition prior to the spill or release. The Contractor shall ensure that all vehicles used to transport RML wastes have all the all required stickers, permits and licenses required by federal, state and local regulatory authorities for the transportation of hazardous materials in commerce. Liquid waste streams: satellite waste containers ranging in size from 1 gallon to 5 gallons. The Contractor shall bulk (consolidate) compatible liquid wastes from multiple containers into a larger container(s) of appropriate size and type. The purpose of waste consolidation is to reduce the number of containers requiring storage or shipment for off� site disposal.� Consolidate, remove and dispose of non-halogenated, flammable, toxic liquid wastes. These wastes will include some, but not all of the following flammable or combustible chemical: acetone, benzene, cyclohexane, dioxane, MEK, ethanol, ethyl ether, toluene, hexanes, heptane, propanol, methanol, xylene, styrene, pentanes, formaldehyde, tetrahydrofuran, nitrobenzene, isoprene, other alcohols, ketones, and esters. Consolidate, remove and dispose of halogenated, flammable, toxic liquid wastes. These wastes will include some, but not all of the following chemicals: chloroform, methylene chloride or any compound containing fluorine, chlorine, bromine, and iodine elements of Group 7A (VllA) as indicated on the Periodic Table of Elements. Consolidate, remove and dispose of corrosive liquid wastes. These wastes will include some, but not all of the following chemicals: nitric acid, formic acid, trichloroacetic acid, chromic acid, hydrofluoric acid, trifluoracetic acid, and phenolic acid. Consolidate, remove and dispose of multi-component, non-halogenated, toxic liquid waste mixed with some organics. These wastes will include but not be limited to the following chemicals:� 2-mercaptoethanol, silver nitrate, tris(hydroxyethyl) aminomethane (aka Tris Buffer), guanidine hydrochloride, formaldehyde, and paraformaldehyde. Remove and dispose of waste oil-based paint material. Remove and dispose of 55 gallon drums of xylene waste and provide replacement 55 gallon drums accordingly. Remove and dispose of 55 gallon drum containing crushed mercury bulbs and provide replacement 55 gallon drum. All documentation of waste shipping, processing, and reporting the final disposition of wastes shall be in metric units of mass (kilograms) unless otherwise specified.� Wastes may be billed or invoiced in non-metric units such as pounds (U.S.). Reporting requirements: The Contractor shall provide Department Of Transportation (DOT) emergency response guide information in accordance with 49 CFR 172.602. The Contractor shall provide the 24 hour emergency phone number required by 49 CFR 172.604 and provide coverage of the number during periods when RML waste shipments are in transit to TSDFs. Container Contents Sheets:� The Contractor shall prepare a container contents sheet (CCS) for each container, lab pack and bulk, in the waste shipment.� The Contractor shall submit completed forms to the COR for review and signature along with the hazardous waste manifest.� The signed original of these forms shall accompany the shipment and copies submitted to the Program officer. Land disposal of RML wastes is not permissible. The Contractor shall prepare in accordance with 40 CFR 268.7, notification and certification forms, land disposal restrictions for all shipments of hazardous wastes. The Contractor must provide certificates of treatment, destruction, or recycling accounting for every container manifested from the RML. These documents must indicate the date, location, and tracking number for each shipped container. The Contractor shall use the Uniform Hazardous Waste Manifest (EPA Form 8700-22) in accordance with EPA and State regulations. No later than 24 hours prior to a planned shipment of wastes, the Contractor shall deliver a complete set of shipping documents, including the LDR forms, to the Project Officer for review.� The Project Officer or designee will be available for signing manifests and other required shipping documents on the day of shipment during core business hours. Shipment Discrepancies: The Contractor shall notify the Program Officer immediately if a discrepancy occurs with a waste shipment and shall work with the TSDF and Program Officer to resolve any issues.� The proper manifest corrections shall be made on generator, and facility copies of the manifest. When discrepancies cannot be corrected on all manifest copies, the Contractor shall prepare manifest discrepancy letters for the review and signature of the Contracting Officer.� The Contractor shall ensure that the return copy of all manifests are delivered to the Project Officer, within the regulatory required time frame otherwise an exception report will have to be prepared and submitted to the appropriate regulatory authority. All spills or releases shall immediately be reported to the Program Officer. The Contractor shall comply with all applicable federal, State and local laws, regulations, executive orders, resolutions, operating permits and licenses governing the management and transportation of hazardous wastes including but not limited to the following: DOT Regulations for Hazardous Materials - 49 CFR Parts 100-199 Federal Motor Carrier Safety Regulations - 49 CFR Parts 382, 383, 390-397 EPA Regulations for Hazardous Waste - 40 CFR Montana State Regulations for Hazardous Waste Comprehensive Procurement Guideline for Federal Agencies - 40 CFR Part 247 Non-ozone Depleting Products - Section 613 of the Clean Air Act OSHA Hazardous Waste Regulations RML waste shall not be deep well injected. The definition of a well is codified in the UIC regulations at 40 CFR 144.3 Quoting instructions: Name and location of the Disposal Facility and locations are required to be submitted with quotation. A list of any excluded compounds, hazard classes, or EPA waste codes that will not be accepted for disposal. Past Performance history of the facilities federal and state regulatory compliance for the past 3 years. �A copy of all required licenses is required with quote submission, see below: Interstate/Intrastate transport licenses Place of Performance: NIH, 903 South 4th Street, Hamilton, MT, United States.� The government intends to award a firm fixed price purchase order to the responsible contractor as a result of this RFQ that will include the terms and conditions set forth herein.� The award will be based on the following; technical capability to meet the requirements and price.
