- COMBINED SYNOPSIS/SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the procedures contained in FAR Part 12.6, Acquisition of Commercial Items, and FAR Part 13, Simplified Acquisition Procedures, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This acquisition is for the selected contractor to provide request for consulting services, Expert Witness capable, USDA ARS-WRRC, Albany, California. (A) The solicitation number is 12905B21Q0023 and is issued as a Request for Quotation (RFQ). (B) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) Number 2021-04.� Service Contract Labor Standards Wage Determination Number 2015-5623 for Alameda County, California is applicable and is attached. (C) This solicitation is issued as Total Small Business Set-Aside. The associated NAICS code is 541350 the small business size standard is $8.00. (D) List CLINS, item descriptions, quantities and units of measure: 0001��� The USDA, ARS, Western Regional Research Center has filed for termination for default on a large ESPC project with Schneider Electric Buildings Americas Inc.� A Department of Justice attorney is working with a USDA Office of General Council Attorney to prosecute this case and it may go to trial.� Both attorneys and our own team of experts involved in this case agree that an independent expert witness is needed.� Consulting service expertise would entail investigating the steam, plumbing, heating, mechanical, electrical, ventilation, air conditioning and building control systems associated with this ESPC project and explore potential errors and omissions and latent design defects associated with them.� This will require a site inspection and engineering analysis.� The results of their findings will be summarized in a written document.� The engineer(s) performing the evaluation need to 1) have not had previous involvement working with Schneider Electric Buildings Americas Inc., 2) have expertise in engineering design of and operation of this diverse set of engineering systems and 3) have experience with ESPC or similar energy savings programs.�� (E) Description/Statement of Work/Specification: Request for consulting services, Expert Witness capable, Albany, CA. (F) Date(s) and place(s) of delivery and acceptance: 90 Days after date of award USDA-ARS-WRRC 800 Buchanan St. Albany, CA 94710 (G) FAR Provision 52.212-1, Instructions to Offerors-Commercial, is incorporated by reference and applies to this acquisition. Please see the attached RFQ terms and conditions for the submission requirements. (H) Evaluation: For the evaluation criteria, please see the attached RFQ terms and conditions. (I) Offerors are required to complete in full FAR Provision 52.212-3, Offeror Representations and Certifications-Commercial Items, with their offer online at SAM: www.sam.gov. �An offeror must state in their offer if they completed FAR 52.212-3 online and that is it up-to-date and valid. See the attached RFQ terms and conditions for more requirements. (J) FAR Clause 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. Please see the attached RFQ terms and conditions for its Addendum. (K) FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, is incorporated and applies to this acquisition. Please see the attached RFQ terms and conditions that are applicable to the acquisition. (L) A statement regarding any additional contract requirement(s) or terms and conditions (such as contract financing arrangements or warranty requirements) determined by the contracting officer to be necessary for this acquisition and consistent with customary commercial practices: N/A. (M) The Defense Priorities and Allocations System (DPAS) and assigned ratings are not applicable to this solicitation. (N) Date, time and place offers are due. Offers are due by May 11, 2021 at 5:00 PM EST. (P) A site visit must be scheduled through the location personnel by email through tara.mchugh@usda.gov or chris.mehelis@usda.gov . This site visit is intended to give prospective offerors the opportunity to familiarize themselves with the location and to gauge the scope of work required of the contract.
