NAICS Code: 115310 Limited-Sources Justification United States Department of Agriculture FAR 8.405 Federal Supply Schedules Multiple Award Schedule Program 1.Identification of the agency and the contracting activity. USDA Forest Service Southern Region Disaster Recovery Support. 2.Description of services required to meet the agency�s needs The services listed above are key components to recovery and restoration efforts caused by Hurricane Michael in 2018. Without moving forward, specifically with tree removal, the dead and down trees (hazardous fuels) will deteriorate and therefore be unmerchantable. As the summer months approaches, warmer and dry conditions dry will dry out the dead and down trees favoring wildfire conditions. This service is a paramount in meeting the agency�s needs in restoring current conditions to historical conditions. Therefore, awarding this contract to Mohawk Valley Materials is compelling because they completed over half the work in this project area, familiar with our statement of work, know the geography and lay of the land, and posed and ready to go.� 3.The circumstances and rationale for limiting competition. Work was stopped on 1243ZP20F0089, 1243ZP20F0064, 1243ZP20F0028, & 1243ZP20F0013 due to covid. 8.405-6(a)(1)(i)(B). MOHAWK VALLEY MATERIALS is BPA holder 1243ZP19A0061. � 8.405-6(a)(1)(i)(C). MOHAWK VALLEY MATERIALS is the only firm capable of providing the services without the USDA Forest Service experiencing substantial duplication of cost that could not be expected to be recovered through competition and would result in unacceptable delays in fulfilling its requirements. Services are unique and highly specialized; this work is a logical follow-on order that represents the best value. FAR 5.202 Exceptions - (11) The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action. �4. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research was conducted. Statutory requirement to obtain maximum practicable competition in simplified acquisitions is met where agency uses competitive procedures in establishing blanket purchase agreements (BPA) with multiple vendors; under these circumstances, there is no requirement that the agency conduct a further competition among the BPA holders in connection with each individual purchase order subsequently issued under the BPAs. This vendor competed and was selected under the Blanket Purchase Agreement.
