- SPECIAL NOTICE NEGOTIATION A SOLE-SOURCE CONTRACT SINGLE SOURCE DETERMINATION USING SIMPLIFIED ACQUISITION PROCEDURES (SAP) FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD (AUTHORITY: FAR 13.106-1(b)(1)) Agency and contracting activity. Department of Commerce, NOAA Office of Marine and Aviation Operations, Acquisition, Analysis, and Accountability Branch. Description of supplies or services required to meet agency needs (including the estimated value). One annual subscription for Flight Management System Navigation Data for aircraft N49RF�s Honeywell International FMS unit. Navigation Data provides FAA-required data for the United States, Atlantic Ocean, Canada, Alaska, Hawaii, Latin America, and the Caribbean. Supporting rationale. Only one source or brand name is reasonably available as detailed below: Brand Name � This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. Jeppesen is the only provider of required navigation data for Oceanic, Caribbean, and Latin American areas of operation. Without this subscription, aircraft could be grounded which will cause delay in the government�s mission. � �Compatibility to existing systems or equipment - The required supplies or service must be compatible in all aspects (form, fit, and function) with existing systems or equipment and the source is uniquely qualified to meet the requirement. Navigation data is provided in partnership with installed Flight Management System manufacturer. � Exclusive Licensing Agreement - The source provides proprietary data that can only be updated by the OEM manufacturer. The North American Industry Classification Code (NAICS) for this acquisition is 518210 Data Processing, Hosting, and Related Services; the small business size standard is $35.0 Million Scope Period of Performance Subscription furnished under this award shall be for one year Jan 20, 2021 to Jan 19, 2022. Subsequently this requirement is required each year unless hardware is changed or upgraded. The Government is not aware of any other vendors that are authorized to provide, service, or support this NAVData, without compromising OEM, propriety, warranty, delivery, or additional markups. The Government intends to acquire these subscriptions under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items. The Government intends to solicit and negotiate directly with Boeing Digital Solutions, under the authority of FAR 13.106-1(b)(1)(i). This is not a solicitation for competitive quotes. However, if any authorized party that can provide this subscription/licensing without compromising manufacturing delivery or mark ups may submit a statement of capabilities, which if in timely received, will be considered by NOAA OMAO. A statement of capabilities to include the detailed service including manufacture authorization, and OEM agreement, and a price list, this shall be received by 08:00 AM EST on 04 January 2021. A determination by the Government not to compete this proposed requirement is based upon responses to this notice and it is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of the required service while also be authorized by the manufacture. The capability statement, a price list and any other information furnished must be in writing and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the system requirements.
