- Identification of the agency and the contracting activity, and specific identification of the document as a �Limited Source Justification.� This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02). Nature and/or description of the action being approved. �This action will award a purchase order, on a brand specific basis, to acquire CPV valves. These valves are required for the direct replacement of existing valves that are obsolete. A description of the supplies or services required to meet the agency�s needs (including the estimated value). This memo does not authorize acquisition for other requirements. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor�s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. Only CPV components can be used in the Ocean Simulation Facility, Environmental Conditioning System (ECS) by approval and direction of NAVSEA 00C. These components form highly specialized life support systems under the NAVSEA Diving Certification Authority. Only those articles which have been successfully tested are qualified. Procedures are specified under SS521-AA-MAN-010 U.S. Navy Diving and Manned Hyperbaric Certification Manual. The objective of this process is to verify that the life support system provides acceptable levels of operator safety throughout the specified operating range. CPV is a global developer and provider of high-quality and reliable fluid system solutions including products, assemblies and services for the research, instrumentation, process, oil and gas, power, petrochemical, alternative fuels, and semiconductor industries. Using alternate equipment would prove costly in time and dollars to the Government and to the mission through possible decertification of the Ocean Simulation Facility system. Additionally, use of alternative components may change or introduce new parameters that may be harmful to the user of the Life Support system.� Therefore, it is imperative that the CPV brand of equipment is purchased. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). �The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government�s needs. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. As stated in paragraph 4 above, the CPV product is the only suitable brand for replacement of valves to match existing performance characteristics and safety. Market research has shown there are multiple vendors that can provide the CPV brand. Any other facts supporting the justification. �Replacement of existing valves is currently schedule for the December maintenance availability period. Exact replacement components are needed to perform this critical diver�s life support system maintenance and to adhere to system certification. Substantial delay in material procurement could delay or disrupt mission-critical testing and operations on diving and life support items. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, the CPV product is the only suitable valve for replacement of existing valves to match performance characteristics and maintain system certification.
