Dingell Veterans Affairs Medical Center Engineering (138) 4646 John R. Street Detroit MI 48201 2237: 553-21-1-3102-0003 Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This procurement is for Airflow Testing & Calibration services. This will be a new contract action. Order against: FSS Contract Number: GS07F217CA Name of Proposed Contractor: Siemens Industry, Inc. Street Address: 1000 Deerfield Parkway City, State, Zip: Buffalo Grove IL 60089-4547 Phone: 616-216-3054 Description of Supplies or Services: The estimated value of the proposed action is $ 477,431.00 The contractor provides Airflow Testing and Calibration services whereby the contractor will: measure all supply, return, exhaust, and hoods in each specified room according to American Society of Heating, Refrigeration, and Air-Conditioning Engineers (ASHRE) standards make sure all Biological Safety Equipment (BSE) cabinets and Laminar Flow Hoods are working correctly per design air flows prior to testing of the room or area perform calculations to determine the number of air exchanges per hour (Supply, Return, and Exhaust) in each room based on the supplied cubic feet per room. compare readings to the original HVAC building design air flow readings adjust the Variable Air Volume (VAV) boxes or Constant Volume boxes. If the readings are more than plus or minus 5%-10% of the HVAC designed air flows. make minor controls adjustment to the VAV or Constant Volume boxes to get the readings back to building design if possible. make sure that any VAV or Constant Volume boxes that have Terminal Equipment Controllers (TEC) shall be calibrated so the readings match the actual flows that are recorded. This may require making control adjustments. Record the supply, and return coefficient of these boxes and update the information in the TEC. The primary Building Automation System on site is Siemens Apogee Insight and requires a Siemens Industry contractor with specific knowledge to perform the requirements of the contract. The resulting contract will include a base year with four (4) one year option periods, and an anticipated award date of October 1, 2020. Identify the Authority and Supporting Rationale: FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Siemens is the manufacturer of the automation system which requires their proprietary software and upgrades that can only be supplied and installed by Siemens. All readings to TEC s as well as hood controllers that must be entered into the automation system is proprietary and needs factory trained service technicians to adjust programming and make necessary changes. Maintenance solutions are developed by the manufacturer to meet changing environments unique to the machinery. Many of the interconnected systems are still under manufacturer warranty and any other contractor allowed to work on these sytems will void the warranty. Siemens does not have any authorized distributors capable of maintenance on their equipment. The risk associated with considering a company other than the OEM in performing this work and the potential consequences of obtaining another company to perform this work are unacceptable performance risks and duplication of cost which is not in the best interest of the Government. FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: The Contracting Officer anticipates the cost will be fair and reasonable as a result of comparison to historical pricing. This requirement has been awarded to Siemens for at least the past 6 years with contract pricing identified in past FSS orders: GS-07F-8728D / VA251-15-F-0002 GS-07F-217CA / VA251-15-F-2737 Describe the Market Research Conducted: Used VA s VIP database to identify verified capable SDVOSBs and VOSBs. VIP results indicate 1,333 SD/VOSBs under the NAICS; however,software and licensing for this equipment is proprietary to the OEM, Siemens. No other contractor can provide the required services for the existing equipment and infrastructure. Any Other Facts Supporting the Justification: None. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: The existing Siemens control system infrastructure is forward and backward compatible by design. This allows for expansion and modification to the infrastructure without the need to wholesale replace the infrastructure. The Research and Development and intellectual property involved in the development of programming algorithms is cost prohibitive to the Department of Veterans Affairs. Therefore, it is not in the best interest of the Government to replace the Siemens infrastructure. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
